A Non Government Organization is registered as a Society under Indian Societies Act 1860

takes a time period of 7 to 8 months time approximately for the registration of Society from
the date of filing of the application.

A Society is formed at both state and National Level. Minimum 7 members are needed in the
formation of society for state level where in case of national level formation, minimum 8
members are required from different state each.

For society registration in delhi, one needs to supply one member from Delhi with Aadhar
Card along with one address proof either electrical power expense or water costs of any
authorized location in Delhi. Rest 8 members can be from any part of India on the condition
that every member should be from separate state.

At the time of registration, 2 photos and address evidences of all the members are required.
Voter id card, ticket, driving license or aadhar card can be sent as an address proof. Further,
at the time of society registration, 2 members are required for witness who should have
aadhar card from Delhi.

The Society can work in entire India. Normally, a member is not enabled to benefit or profit
from his position unless the society document particularly allows for payments to the member
for providing services.

A member of society might be terminated from the society on fatality, composed resignation,
unsound mind or if the member is found to be included in any anti social activities or has
actually not attended 3 consecutive meetings of the Governing Body without information or
if the member is requested to resign by two-third or as near thereto possible of the remaining
governing body members.

There is one member as the Management Member of the Society. A society can allow its
beneficiaries to choose committee or committees from among themselves for the effective
and smooth running of any certain branch of its activities. According the section 20 of the
Societies Registration Act, 1860, the following societies can be registered under the Act:
'charitable societies, military orphan funds or societies established at the several presidencies
of India, societies established for the promotion of science, literature, or the fine arts, for
instruction, the diffusion of useful knowledge, the diffusion of political education, the
foundation or maintenance of libraries or reading rooms for general use among the members
or open to the public, or public museums and galleries of paintings and other works of art,
collection of natural history, mechanical and philosophical inventions, instruments or
designs.'

The main motto of any society is the memorandum of association and rules and regulations
(no stamp paper required), wherein the aims and objects and mode of management of the
society should be enshrined. A Society needs a minimum of seven managing committee
members; there is no upper limit to the number managing committee members. The Board of
Management is in the form of governing body or council or a managing or executive
committee. They can form guidelines and policies for that particular branch under the given
conditions

6. List of the members of the society
7. Self-declaration from the president of the society
8. Duly filled society registration form
9. Receipt of society registration fees

What is the eligibility criteria for society registration?

One of the following should be your region behind incorporation of you society in India:

1. Grant of Charitable assistance


2. Promotion of Fine arts
3. Promotion of Science and Literature
4. Creation of Military orphan funds
5. Diffusion of political education
6. Maintenance or foundation of galleries or public museums
7. Maintenance or foundation of reading rooms and libraries
8. Promotion of diffusion and instruction of useful knowledge
9. Promotion of labour welfare with labour cooperative society registration

Affidavit in prescribed format by the President / Secretary / General Secretary on Rs. 10/-
Non-Judicial Stamp Paper regarding the relationship between the subscribers (desirous
persons) to the Memorandum and that the name of the society will be changed/rescinded if
the said name already found registered (this affidavit is required to be attested by an Oath

Commissioner, Notary Public with Rs. 5/- Notarial stamp affixed thereon or Magistrate 1
Class) - One Copy in original.

NOC-cum-Affidavit in prescribed format by the owner/GPA holder of premises shown as


registered office of the proposed Society on Rs. 10/- Non-Judicial Stamp Paper (in original)
supported with duly attested Proof of Address i.e., Electricity Bill / Water Bill/ Property
House Tax Receipt etc. (in the name of owner/GPA holder) - One copy

Attested copy of documentary proof in the shape of Sale deed / Lease deed / General Power
of Attorney in r/o premises shown as registered office of the society.

Residential address proof like the copy of Aadhaar Card/Passport/Voter ID of all desirous
persons which may be self attested or attested by a Gazetted Officer/Notary Public/Oath
Commissioner.

Note:-

All the signatures of the desirous persons/subscribers of the Memorandum must be witnessed
by an Oath Commissioner, Notary Public (Notarial stamp affixed), Gazetted officer or
Magistrate 1st Class with their official rubber stamp.

Signatures of minimum 03 office bearers are required on each and every page of the
Memorandum and Rules & Regulations of the Society.

The names of the persons mentioned in the Governing Body of the Memorandum must
necessarily be included in the list of desirous persons/subscribers to the Memorandum. In
other words the members of the Governing Body cannot be outside from the list of desirous
persons/subscribers to the Memorandum.

In case management of or reference to a particular existing places of worship like Mandir,


Gurudwara, Masjid, Church or Budh Vihar etc. is involved sufficient documentary proof is
required that the society is legally competent for the same.

To have working area as DELHI, minimum 07 (seven) desirous persons should be from
Delhi; and to have working area as All INDIA, the desirous persons should be from 07
(seven) different States of India including one from DELHI.
