1989 का और संशोधन करने के िलए,

िननिलिखत ाप, िजसे क ीय सरकार मोटर यान अिधिनयम, 1988 (1988 का 59) क धारा 64 के खंड (क) ारा द!त
शि#तय का योग करते %ए बनाने का (ताव करती है, को उ#त अिधिनयम क धारा 212 क उपधारा (1) ारा
यथापेि+त उन सभी -यि#तय क जानकारी के िलए िजनके उनसे भािवत होने क संभावना है, कािशत कया जाता है
और नो3टस दया जाता है क उ#त ाप िनयम पर उस तारीख से जब इस अिधसूचना क ितयां, भारत के राजप7 म
यथाकािशत, आम जनता को उपल9ध कराई जाती है, से तीस दन क अविध क समाि:त के प;चात् िवचार कया जाएगा;

1. (1) इन िनयम का संि+:त नाम क ीय मोटर यान (..........संशोधन) िनयम, 2016 है ।
(2) ये राजप7 म इनके अंितम काशन क तारीख को वृ!त हगे ।
2. क ीय मोटर यान िनयम, 1989 म, िनयम 47 म, उपिनयम (1) म, पंरतुक के (थान पर िननिलिखत परं तुक
रखा जाएगा, अथाDत् :—

“परं तु 30 िसतंबर, 2016 तक, ई-

(संशोधन) िनयम, 2015 के काशन क तारीख को और से और क ीय मोटर यान (16वां संशोधन) िनयम, 2014 के

काशन से पूवD िवKमान ई-काटDस तथा का.आ. 2590(अ), तारीख 8 अ#तूबर, 2014 ारा कािशत अिधसूचना,
इस उपिनयम के अधीन रिज(Fीकरण के िलए आवेदन प 20 म प 21 और प 22 जारी करने क तारीख से
सात दन क अविध के भीतर रिज(Fीकरण ािधकारी को कया जाएगा और उसके साथ िननिलिखत संलMन कए
जाएंगे –

(i) प 22 म िविनमाDता या -यौहारी या रिज(Fीकृत ई-3र#शा या ई-काटD संगम या राOय सरकार ारा
ािधकृ त कसी अिभकरण ारा जारी कए जाने वाला सड़क योMयता माणप7 ; और

(ii) प 21 म िविनमाDता या -यौहारी या रिज(Fीकृत ई-3र#शा या ई-काटD संगम या रिज(Fीकरण के िलए
आवेदन के साथ (तुतीकरण के िलए राOय सरकार ारा ािधकृ त कसी अिभकरण ारा जारी कए जाने
वाला िवPय माण प7 ।”

2 जून, 1989 को कािशत कए गए थे और अंितम बार अिधसूचना सं. (अ), तारीख को संशोिधत कए गए ।

NOTIFICATION
New Delhi, the 24th June, 2016
G.S.R. 628(E).—The following draft of certain rules further to amend the Central Motor Vehicles
Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by clause
(a) of sections 64 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by
sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and
notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of
30 days from the date on which the copies of this notification as published in the Official Gazette, are made
available to the public;
2. Any objections or suggestions received from any person with respect to the said draft rules
within the expiry of the period so specified will be considered by the Central Government.
3. Objections or suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of
Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110001, within the period
specified above.
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (………Amendment) Rules, 2016.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989, in rule 47, in sub rule (1), for the proviso, the
following proviso shall be substituted, namely:—
“Provided that upto 30th September, 2016, on and from the date of publication of the Central Motor Vehicles
(Amendment) Rules, 2015 published on 13th January, 2015, in respect of the models of the E-rickshaws and
E-carts existing prior to publication of the Central Motor Vehicles (Sixteenth Amendment) Rules, 2014 and
the notification published vide S.O. 2590(E) dated the 8th October, 2014, the application for registration under

this sub-rule shall be made in Form 20 to the registering authority within a period of seven days from the date
of issue of Form-21 and Form-22 and shall be accompanied by—
(i) road worthiness certificate in Form-22 to be issued by the manufacturer or dealer or registered
E-rickshaw or E-cart Association or any agency authorised by State Government; and
(ii) Sale certificate in Form 21 to be issued by manufacturer or dealer or registered E-rickshaw or
E-cart Association or any agency authorised by State Government for presentation along with
the application for registration.”
