11th August, 2023 and is hereby published for general information:
THE JAN VISHWAS(AMENDMENT OF PROVISIONS)ACT, 2023

AnAct to amend cetain enactments for decriminalising and rationalising offences
tofurther enhance trust-based govemance for ease of livingand doing business.
BE itenacted by Parliament in the Seventy-fourth Year of the Republic of India as
follows:
1.(/) This Act may be called the Jan Vishvwas (Amend1ment of Provisions) Act, 2023. Short title and
(2)It shallcome into force on such date as the Central Government may, by notification in comnencement.
the OfficialGazette, appoint; and different dates may be appointed for amendments relating
to different enactments nentioned in the Schedule.

2.The enact1ments mentioncd in column (4) oftheSchedule are hereby amended to the Amendment
extent and in the manner mentioned in column (5)thereof. of certain
enactinents.
3. The fines and penalties provided under various provisions in the enactments Revivion nf
mentioned in the Schedule shall be increased by ten per cent. ofthe minimum amount of fine fnes and
or penalty. as the case may be, prescribed therefor, after the expiry of every three years from penalties.

account or othcr document or lo furnish any

provisions of this Act, it is his duty to produce or
furnish, he shall be liable to penalty which may
cxtend to onc lakh fifty thousand rupccs in respcct
of cach failurc, and in thc casc ofa continuing
failure, with an additional penalty which may
cxtend to scven thousand five hundred rupces
for every day during which the failurc continucs
afier the first such failurc.
(3) For the purposc of adjudging thcpenalty
under sub-scction (2), the Corporation shall serve
noticc on the person rcquiring it to show cause
why thec amount specificd in the noticc should
not be imposed and a reasonable opportunity of
being hcard shall also be given to such person.
(4) Any pcnalty imposed by the
Corporation under this section shall be payable
withina period of fourteen days from the date on
which notice issucd by the Corporation
demanding payment of the sum is served on the
person and in the event of failure ofthe person to
pay the sum within such pcriod, may be levicd on
an order or dircction made by the principal civil
court having jurisdiction in the arca whcre the
person is situatcd:
Providcdthat no order or direction shall bc
made except on an application made to the court
by the Corporation or any officer authorised by it
in this bchalf.
(5) The court which makes an order or
dircction under sub-section (4) shall issue a
certificatc spccifying the sum payable by the
person and every such certificate shall be
enforceable in the same manner as if it were a
decree made by the court in a civil suit.
(6) Nocomplaint shall be filed against any
person in any court of law in respect of any
contravention or default in respect of which any
penalty has been imposed by the Corporation
under sub-scction (2).
(7) Whcre any complaint has been filcd
against any person in any court in respect of any
contraventionor default of the nature referrcd to
in sub-scction (/), then, no proccedings for the
imposition of any penalty on the person shall be
initiated under sub-scction (2).".
