1- This is an application for issuance of heirship certificate under the

provisions of Bombay Regulation VIII of 1827. Read the application and
the evidence produced by applicants in support of it. Heard Ld. Advocate
for the applicants.

2- According to the applicants, the applicant no. 1 is widow and the

applicant no. 2 is son of deceased Bhaguji Bhiku Hole who died on
02/12/1991 at Saswad, Tal. Purandar, Dist. Pune. After his death it become
necessary for the applicants to get recognized as his legal heirs. Therefore,
they made this application.

3- After making of present application by the applicants a

proclamation in the form contained in Appendix A of the said Regulation,
inviting all persons who dispute the right of the applicants who appear in
the court within 1 month from the date of proclamation and entered their
objection was published in a daily PunyaNagari dated 24/11/2020.
However, at the expiration of time mentioned in the proclamation, no
person has appeared and objected this application.

4- Thereafter, the applicant no. 1 has examined herself at exh. 11 and

various documents at exh. 14 to 19. From these documents it clearly
appears that, the applicants no. 1 and 2 are legal heirs of deceased Bhaguji
Bhiku Hole who left behind certain immovable property. However, if the
prayer clause in the application is perused it appears that, the applicants
have sought formal recognition of heirship. Hence, in view of the

provisions of Section 3 of said Regulation, the application needs to be

allowed. Therefore, I pass the following order.
ORDER
Issue heirship certificate in the form contained in Appendix B of Bombay
Regulation VIII of 1827 formally recognizing the applicants no. 1 and 2
as legal heirs of deceased Bhaguji Bhiku Hole who died on
02/12/1991 at Saswad, Tal. Purandar, Dist. Pune.
