(Passed on this 28th the day of September 2021)

1. Perused   the   application   and   say.   Heard   Shri.

Mayoor Moon, the learned counsel for the applicant/accused
and Shri. Takwale the learned P.P. for State.

2. It is the submission of the learned counsel for the
applicant/accused that the brother of the accused expired on
27.09.2021   as   he   was   murdered.   Therefore,   the   applicant/
accused   has   to   perform   the   rituals   of   his   brother.   Hence,
prayed for grant of permission. 

3. Per contra, the learned Public Prosecutor filed the
say and submitted that the permission may be granted subject
to   condition   that   the   applicant/accused   be   sent   under   the
police custody after due compliance of the procedure.

4. Perused   the   application,   say.   Considering   the

reason mentioned in the application and in view of the say
given by the learned Public Prosecutor, in my opinion there is
no harm in granting the permission to the applicant/accused
to attend the funeral for the purpose of completing the rituals.
Hence, the following order.
                                          ORDER

1. Application is hereby allowed.

2. The applicant/accused is permitted to attend the funeral
of his deceased brother scheduled on 28.09.2021.

3. The applicant/accused is hereby directed to complete the
formalities   in   respect   of   Jail   by   paying   the   requisite
charges for obtaining the Police guard.

4. The permission is granted upto 8.00 pm. of 28.09.2021.
The   applicant/accused   shall   surrender   himself   at   or
before the granted time.

5. Humdast is allowed.
