FIRST CODICIL TO LAST WILL AND TESTAMENT

MARYLEE JOYCE HEATH

I, Marylee Joyce Heath, a resident of Franklin, Ohio, being of sound mind, do hereby make the
First Codicil to my last will and testament which is dated June 6th , 2007. If any statement in the
Codicil to the Last Will and Testament of Marylee Joyce Heath contradicts my Last Will and
Testament dated 6th day of June 2007, the Codicil shall control.

I am making the following additions or changes to my will:

AMENDMENT TO STRUCTURE OF TESTAMENTARY TRUST OF

MARYLEE JOYCE HEATH

Marylee’s estate updated to read 100% retained in testamentary trust with HEMS payments to
Christian until he turns 21 years of age, then split 40%/40% and distributed to the following 2
children: Christian Javier Wynn and Brittany Nikia McCoy. Any 401K and IRAs remaining after
my death, should be included in the estate for equal distribution as designated in the above
paragraph.

AMENDMENT TO MY LAST WILL AND TESTAMENT OF

MARYLEE JOYCE HEATH

Strike sentence “I have another naturally born daughter, Jeannette Malko, an adult.” Amend next
statement to read: for purposes of the Will, any reference to my “child or children” shall mean
Brittany Heath McCoy and Christian Wynn. I intend by the Will to provide for my legally
recognized children.

All entries of the name Brittany Heath, shall be changed to read Brittany Heath McCoy who has
married since the initial signing of my will dated 6th day of June 2007.

In witness whereof, I have subscribed my name to this, my amendment to my Last Will and
Testament dated the 6th day of June 2007.

Every other aspect of my will shall remain intact, and I confirm and ratify my said Will.
