STATUTORY NOTICE UNDER SECTION 138 0f THE NAGOTIABLE

INSTRUMENTS ACT 1881 AS AMENDED UPTODATE

Dear Sir,

Under instruction from and on behalf of my client, Mr. Hammer Odinson S/o Mr. Thor
Odinson R/o A 96 Sector 23 Noida U.P.-201301. the following legal notice is being
served on you :-
1. That Mr. Hammer is the owner of Asgard Paints & Hardware store located at
Commercial Complex ,Sector 27 , Noida -201301 and usually deals with many
contractors and builders for their operational needs.

2. That one such contractor is Mr. Holmes(you) with whom Mr. Hammer had a
long history of a business relation.You usually bought plumbing supplies and
electrical lights for installation in his on going projects. Mr. Hammer gave the

inventories usually on credit and you would pay up the due amount after
completion of his projects.
3. That on 03/03/2024 , Mr. Hammer in the usual course of business sent an
order worth Rs5,00,000/-(Five Lakhs only). The order consist of 1000 units
LED bulbs and 700 units of plumbing pipes to be sent to the on going project
at Shalimar building Sector -105 Noida as demanded by you. Upon delivery
you issued a post-dated cheque dated 01/04/2024, drawn on Punjab National
Bank, bearing cheque number 123456, as a payment assurance.
4. That due to financial constrains and bad market conditions Mr. Hammer was
in a dire need of money. Mr. Hammer goes to his bank to present the cheque
on the morning of 01/04/2024. Due to usual past conduct, without slightest
apprehension in his mind believing the cheque would be encashed latest by
next day Mr. Hammer ordered stock material for his store worth Rs.4,00,000/-
(Rupees Four Lakh only). However, when Mr. Hammer presented the cheque
for encashment on 01/04/2024, at his bank ( Punjab National Bank, Sector-18
Noida) he was dumbstruck as it was dishonored by the bank citing "insufficient
funds."
5. That Mr. Hammer calls you on your cellular phone, and you assure him the
funds will be in his account by end of the day. The next day ie on 02/04/2024
Mr. Hammer calls you again but you deliberately avoided his calls. In the
meanwhile the supplier of stock material delivers the order of Mr. Hammer to
his store premises and demands payment. Helpless Mr. Hammer is forced to
return the stock material. This ordeal not only was embarrassing but also
destroyed the reputation and goodwill of my client in the market.
6. That the next couple of days you provided false assurances and make fake
promises of payment . It has also been brought to notice of my client that you
are in attempt to dodge payments of various other lenders of yours.
7. That you have maliciously, dishonestly and fraudulently issued the said
cheque in discharge of your liability, having full knowledge that said cheque
shall not be encashed, as you did not have sufficient amount in your bank
account to honour the cheque, thus you have cheated my client.

I, therefore, through this legal notice call upon you to pay the amount of dishonored
cheque of Rs500000/- (Rupees Five Lakhs Only) to my above said client, within 15
days from the receipt of this legal notice, failing which my client shall have no option
but to initiate appropriate proceedings criminal as well as civil against you in the court
of competent jurisdiction at your own costs, risks, expenses and consequences.
Copy of this legal notice is kept in my office for further reference and action.
