PURPOSE To decide on an application for extension of liquor trading hours in terms of Section 6(1) of the City of Cape Town: Control of Undertakings that Sell Liquor to the Public By-Law, 2013 4. FOR DECISION BY Subcouncil in terms of Delegation 4(2) To approve, refuse or vary applications for extension of trading hours on premises where liquor licenses have been granted. 5. EXECUTIVE SUMMARY The City of Cape Town: Control of Undertakings that Sell Liquor to the Public By- Law, 2013, was promulgated on 17 January and coming into effect on 01 February 2014. An application for extension of liquor trading hours in terms of Section 6 (1) of the By-law was submitted to the Health Directorate and circulated to the relevant ———$$ ———— ———— ———————___ Page 1 6.4 on 6 a departments for comment. The fully signed application, including all required comments was submitted to the Manager Subcouncil 2 and was then circulated ‘to abutting neighbours, all organisations included on the Ward 111 database and ward committee members for comment. Clause 9 of the By-law requires that the City must, before approving an application for the extension of trading days and hours, reasonably and fairly consider further factors which must include, inter alia- (a) the validity of the liquor licence; (b) where applicable, the validity of a business license issued in terms of the Businesses Act of 1991 (Act No. 71 of 1991); (©) location category as per the Schedule; (@ previous suspension, amendment or revocation of extended trading days and hours including previous records of complaints investigated and confirmed in respect of the last twelve months preceding a current application for extension; () _ the proximity of the licensed premises to surrounding residential zoned area, cultural, religious and educational facilities; () outcome of community consultation and the recommendation of the relevant ward; (9) the potential impact on the surrounding environment; (h) whether it is in the public interest to approve and grant an extension of trading days or hours; or () a motivation from the applicant dealing with the impact of ~ ()___ the risks to and nuisances on the surrounding community; (i) mitigation measures to assist the control of risks and nuisances; and (li) possible benefits of extended liquor trading hours and days on the surrounding community. (10) The basis and rationale behind all decision-making must be recorded DISCUSSION Section 6 (1) of the By-Law reads as follows 6(1) Subject to subsection (6), (6) and (7) a licensee may upon payment of the required fee, submit a written application to the City to extend the liquor trading days and hours of licensed premises. WcP/002340 1, This application was approved in 2016 and re-application is now being made as the approval will lapse on 1 October 2017. A copy of the approval letter from 2016 is annexed. The Applicant has received no complaints regarding the use of the extended trading hours in the past year and it is submitted that no one will be prejudiced by the re- approval of the extended trading hours and that this will be in the interests of the customers. 2. Under previous liquor legislation (Liquor Act 27 of 1989) the licensee was entitled to trade until 20h00, Monday to Friday. This applied for many years without any negative impact on the local community. On the contrary, it meant that the business was able to better serve the needs of the local community being more accessible to customers. The licensee Is seeking to recover a right previously held and exercised without harm. (It is submitted that extending this 20h00 closing time to Saturday as well will be a logical step). 573 The licensee has been trading in these premises for many years and has a good record with no complaints regarding its activities being submitted to or investigated (let alone confirmed) by the Municipality or Liquor Authorities in the previous twelve months, There has been no suspension, amendment or revocation of extended trading hours or days in the past. The licensee has provided a good service to the local community for all the years of its operation and this business is an established presence in the community. The licensee wishes to cater for the requirements of the local community to shop for liquor after 18h00 as it was once able to do. The licensed business is situated in a large shopping centre that caters primarily to the surrounding local neighbourhoods, providing their liquor needs from lawful and regulated premises. Many people residing in the community within which the licensed premises are situated are in full time employment, and commute to work each day in other areas. Residents who use public transport, or those commuters in vehicles in increasingly heavy traffic, often find it difficult to get back to their neighbourhoods before 18h00. These people had been accustomed to be able to make liquor purchases after 18h00 and the licensee seeks to be able to accommodate them once again. Itis submitted that preventing large numbers of potential customers from being able to purchase liquor from a licensed business after 18h00 will create a situation whereby some of these customers will seek to make liquor purchases at unlicensed premises or shebeens. This will have the effect of strengthen these illegal traders and as criminal activity is often associated with these illegal traders, crime in the community may well rise as a result thereof. Accordingly, in view of points “4”, “6” and "6” above, the Applicant submits that there will be clear benefits of extending the trading hours for the surrounding community. The licensed premises are clearly situated in a large shopping centre/business area, catering to surrounding residential areas. Being in a business centre the proximity of residential areas will not be impacted negatively. Cultural, religious, and education facilities will likewise not be impacted negatively as they are not in close proximity, the licensed premises being deep within the centre. The Applicant is part of the Aroma Liquors Group that has been trading in liquor retail since 1973. The Aroma Group therefore has vast experience and furthermore has a sound reputation for trading within the letter and spirit of the liquors laws, and operating well regulated and orderly off-consumption outlets. As such, allowing the Applicant these extended trading hours will in no way have a negative effect on the surrounding community, and may well indeed prevent the growth of 10. 11. 12. 13. Pe illegal traders in the area 874 Staff of the licensed premises have been well trained in the operation of a liquor store and in the importance of the liquor laws such as not selling liquor to under age or intoxicated persons. They have also been educated in the potential harmful effects of abuse of alcohol and the impact that this can have on the community, particularly the surrounding community. The Applicant is aware of the social issues of vagrancy and homelessness, the potential of badly managed liquor ‘stores to contribute to these Issues, with a negative impact on the local community. For this reason staff at all the Applicant's branches have received specific instructions not to sell to the homeless or vagrants in their areas so as not to contribute negatively to these social issues. These instructions are monitored and strictly enforced by management. Accordingly, in view of points "9" and "10" above, the Applicant can be seen to have taken, and continues to take, measures to mitigate and assist with the control of risks and nuisances that may be associated with extended trading hours. Itis therefore submitted that for the surrounding community there will be no risks or nuisances associated with the approval of extended trading hours, and only benefits will arise. It will therefore be in the public interest to approve the extended trading hours.
