14-06-2023 – On the first day of internship firstly I go to the District Legal
Service Authority(DLSA) ,Hamirpur(H.P.) .There I submitted an application .
Then they directed me to go to the District Court Hamirpur. They authorizes me
an Advocate, Sh. Virender Singh, under which my internship as has to be done.
He is an Legal aid counsel at front office of District Court Hamirpur. He tell me
about how legal aid works. What sections deals with the legal aid. Section 39A
of constitution tells about Legal Aid. Section-39A deals about the Equal Justice
and Free Legal Aid. They tell me that free legal aid is given to the B.P.L family,
S.Cs , S.Ts, whose salary is less than 36,000 and free legal aid is given to
woman also. Then we visit District Jail Hamirpur. There I meet with jailer, he
tells me about how jail works. That day only introduction of jail is given by the
jailer. He give me information about the parole and farlo. Workings of jail,
visitng hours of family members with prisoners. Talked about the wages of
prisoners.

15-06-2023 – On second day of internship my visit is to court of Additional


Chief Judicial Magistrate. There I observe the court working and have the idea
of how court works. There I observe that from the right hand side of the judge
the stenographer was sitting and on the left hand side the evidence reader was
sitting. And then I saw that the plantiff also stand on the right hand side of the
judge and respondent on the left side of the judge.
16-06-2023 – On the third day of internship I had a visit of Juvinile Justice
Board District Hamirpur(H.P.). First I go to the court then my advocte tell me
that the juvinile court is on at 11:00 a.m. After that I visit the Juvinile Justice
Board with my Advocate. There I notice that the Add. Chief Judicial Magistrate
is the judge of Juvinile Justice Board. The Juvinile Justice Board consists of
Add. Chief judicial magistrate and two social workers. Juvinile justice board are
meant to resolve caese within four month period. Most of the circumstances the
juvinile can be released on a bail by the Juvinile justice board. The bench had
all the powers of a criminal court under the CrPC. It was formed by the virtue of
Juvinile Justice Act.

17-06-2023 – On the forth day of intermship I had a visit of Disrict Jail


Hamirpur. On this firstly I go to the district court from where i go to the District
jail with Advocte Virender singh. The visit to the jail was indeed a remakcable
one. The jail has 3 blocks Block-A, Block-B , Block-C. Block-C is under
construction. The jail contained convicted as well as under trail prisoners. Both
convicted and under trail prisoners are living together. Men and women had
different blocks. There was only three convicted womens in which one had a
life imprisonment and one man has life imprisonment. The convicted ones
whose jail term were less than 10 years were allowed to work from 10am to
6pm in the evening. There were prisoner convicted of various offences like
under Murder, NDPS Act or POSCO Act or Rape.

Prisoners do have Fundamental Rights like Article 10, 14, 21. However , it can’t
impose the Fundamental Rights in its full ponoply to the advantage of the
prisoners.

Right to life and personal liberty.


Right to life with human

dignity. Right to speedy trial.

Right to Legal Aid.

19-06-2023- On the Fifth day of internship I had a visit to Court of ld. Civil
Judge-JFMC, Barsar. Firstly I go to the court to authorized advocate to tell him
I am going to my visit. After that I reached to the prescribed court of Barsar. My
objective is to observe the court working and proceeding and have an idea there
of. I got to know about different stages in court proceedings.

20-06-2023- On the sixth day of internship I had a visit to office of LADCS,


ADR centre, Hamirpur, HP. I reached The ADR centre on 10 am. My objective
is to observe and understand the working of LADCS. There I got to know that
there are two main persons of LADCS which are CHAIRPERSON and the
SECRATERY. Chairperson of the authority is the District and Session Judge.
There I meet the advocate Sh Piyush ji. They tell me about the history of the
legal aid. It is started at 1970 to 1980. They give some information about the
NLSA Act 1978. They tell me that the Defence Councel System is started from
april 2023. Person whose annual income is less than 3 lack is eligible for the
free legal aid. He give some information about the Default Bail. Section 167(2)
deals with the Default Bail.

Then he told about the Lok Adalat and Mediation Center. He told that the Lok
Adalat is of binding nature and mediation was pf non binding nature.
21-06-2023- On the seventh day of internship I had a interaction with the
inmates of Child Care Institution Sujanpur H.P. My objective is to interact with
the inmates and to understand the working of the office of Child Care Institution
Sujanpur. I reached sujanpur at 11 am. There I go to the Child Care Intitution
and meet with the inmates. They directed me to go to the sujanpur ground
because there is a camp of child welfare to know about the function of child
welare and how it can be done. There i saw that the main guest of the function
was District Magistrte of that district. On that day there were the occasion of
International Yoga Day also. It is the responsibility of every State Government
to provide services to children in conflict with law (CCL) as laid down under
the JJ Act 2015 and the JJ Model Rules 2016. Though, JJ Act and the Model
Rules clearly states the procedure for its implementation, however, there are
certain areas which may need special attention of the care givers in a Child Care
Institution (CCI) such as what shall be done in-case of an alleged CCL above
seven years of age and below twelve years and the recidivism. At the institution
they give some information about (CCI) that is- A child care institution as
defined under the JJ Act,2015, means Children Home, Open Shelter,
Observation Home, Special Home, Place of Safety, Specialised Adoption
Agency and a Fit Facility recognized under the Act for providing care and
protection to children, who are in need of such services. Children in conflict
with law are provided residential care and protection in Observation Homes,
Special Homes and Places of Safety.

22-06-2023- On the eighth day of internship i had a visit to Ayushman Drug


Rehabitation Centre, Hamirpur, H.P. My objective is to interact with the
inmates, try to understand their problems and look at the conditions in which
they stay and assess whether they need any kind of legal services etc. So I
reached to the Ayushman Drug Rehabitation Centre, Hamirpur, H.P. at 10 am.
The environment of the rehab was good, the condition of the rehab is very good.
Then I interact with the worker of that rehab who is himself a inmate. There
wese 20 to 25 persons who are staying on Ayushman Drug Rehabitation Centre.
The owner of that rehab give some information about the rehabitation Centres
that is Drug rehabilitation is the process of medical or psychotherapeutic
treatment for dependency on psychoactive substances such as alcohol,
prescription drugs, and street drugs such as cannabis, cocaine, heroin or
amphetamines. They tell me about the perpose of the Rehabtation Centres like
Rehabilitation helps to minimize or slow down the disabling effects of chronic
health conditions, such as cardiovascular disease, cancer and diabetes by
equipping people with self-management strategies and the assistive products
they require, or by addressing pain or other complications.

23-06-2023- On the ninth day of internship I had a visit to the District Child
Welfare Committee, Hamirpur, H.P. My objective is to understand the working
of the office of District Child Welfare Committee, Hamirpur, H.P. I reached at
the District Child Welfare Committee at 10:30 am. Where I meet with Sh.
Shashi kumar ji who is the counseller at the District Child Welfare Committee.
He told me that the there are 5 members in the District Child Welfare
Committee ine is Chairperson and another 5 are the members of that committee.
The Chairperson of the committee is ADV. Rekha Sharma. All the important
decisions are taken by the Chairperson by the meeting with other 4 members. If
the case is not decided by the District Child Welfare Committee, then it goes to
the Juvunile Justice Board. It is regulated by the Juvinile Justice Act. He give
some information about the District Child Welfare Committee like- For the
Children in need and care of protection, State Government may, by notification
in Official Gazette, constitute for every district or group of districts, specified in
the notification, one or more Child Welfare Committees for exercising the
powers in relation to child in need of care and protection under this Act.
The Committee shall consist of a Chairperson and four other members, of
whom at least one shall be a woman and another, an expert on matters
concerning children. The Committee shall function as a Bench of Magistrates.

A child in need of care and protection is produced before CWC for being placed
in safe. The Committee has the final authority to dispose of cases for the
care,protection,treatment,development and rehabilitation of the children as well
as to provide for their basic needs and protection of human rights.

A CWC is a body notified and constituted under section 27 of the JJ Act,


2015 for every district for exercising the powers and to discharge the duties
conferred on such Committees in relation to children in need of care and
protection under this Act.

24-06-2023- On the tenth day of internship i had a intercation with the


inmates of Old Age Home, Muthan, District Hamirpur, H.P. My objective is to
interact with the inmates, try to understand their problems and look at the
conditions in which they stay and assess whether they need any kind of legal
services etc. I reached at the Old Age Home at 10 am. Where I meet with some
old peoples or the care person of that home. He tell me that the Old Age Home
has a capacity of caring 15 to 20 persons but at present there are only 4 persons
at the Old Age Home. He tell me that it is regulated by the District Magistrate
of that area and it is the building of government. There are proper madical
facilities given to the persons living there, proper food, the condition of the Old
Age Home is good. The environment is also goof that area.

26-06-2023- On the eleventh day of internship I had a interaction with the


inmates of Gunjan Drug Rehabilitation Centre, Ward no.5, District Hamirpur,
H.P. My objective is to interact with the inmates, try to understand their
problems and look at the conditions in which they stay and assess whether they
need any kind of legal services etc. I reached at the Centre at 10:30 am. Where I
meet with the counseller of the centre. There I saw that there are only 8 persons
who are affected and come to improve their conditions. The counseller tell me
the all the persons have intakes of atleast 3 years. He told that there are 4 new
relapse case are there. There is only 3 months treatment given to the persons.
Only nicotex is given to the inmates.

27-06-2023- On the twelfth day of internship I had a visit to Court of ld. Civil
Judge-cum-JFMC, Court no.3, Hamirpur H.P. My objective is to observe the
coiurt working and the idea there of. I reached at the Court at 10 am. I saw that
the court is very busy. There were many cases of NDPS etc. There i saw that
how court run how advocates present there cases etc.

28-06-2023- On the thirteenth day of internship I attended Legal Awareness


Programme. My objective is to have an idea of Legal Awareness Programmes
organized by District Legal Services Authority, Hamirpur, H.P. This
programme was organised with the help of a para legal volunteer. Programs on
drugs and alcohol addiction are organized amongest schools, collages, and
industries. There a para vollenteer tell me about the importance of legal
awareness programmes like -Legal awareness, sometimes called public legal
education or legal literacy, is the empowerment of individuals regarding issues
involving the law.[1] Legal awareness helps to promote consciousness of legal
culture, participation in the formation of laws and the rule of law.[2][3]
Public legal education, sometimes called civics education, comprises a range of
activities intended to build public awareness and skills related to law and the
justice system. This term also refers to the fields of practice
and study concerned with those activities, and to a social and
professional movement that advocates greater societal commitment
to educating people about the law. Anna-Marie Marshall explains that "in order
to realize their rights, people need to take the initiative to articulate them. This
initiative, in turn, depends on the availability and the relevance of legal schema
to people confronting problems."[4] This is because laws exist as part of a larger
organizational ecosystem in which the interests of the organization as well as
those of the actors become inextricably linked to the ways in which they are
enacted.
30-06-2023- On the forteenth day of internship I had a visit to the front office,
Hamirpur, H.P. My objective is to observe and understand the working of Front
Office and the role of Legal services lawyers/panel lawyers. I reached the Front
Office at 10 am. There I meet my Advocate Virender singh. He gave me
information about the discharge or challan under section 173(2) and
supplementary challan. There he told me raec the case the DK vasu case in
which the right of Arrested person.

01-07-2023- On the fifteenth day of internship I had a visit again to the Front
Office, Hamirpur, H.P. On thid day my Advocate give some more information
about the working of front office how the application of the aggrived filed.
There is a proper process which is given below-

1) First of all advocate listens the gravience in respect of applicant.


2) Secondly advocate receives the application in respect of appliacnt.
3) Then, application is forwarded to the competent authority.
4) Competent authority issued a letter with endorsement to applicant and
provide to Legal Aid Counsel.
5) After that Legal Aid Counsel deal with the case of applicant free of cost.

03-07-2023, 06-07-2023, 07-07-2023- On these three dates I had a visit to


the Mediation Centre Hamirpur, H.P. at 1 st Floor, ADR Centre, Hamirpur H.P.
There the advovate give me some information about the Mediation Centres and
there importance like- Mediation is one of the Alternative Dispute Resolution
Methods contemplated under Section 89 of the Code of Civil Procedure as
amended by the Parliament.

Mediation is a process in which a neutral third party assists the disputing parties
to creatively resolve their dispute without going to trial. Mediation presents a
unique opportunity for dispute resolution with the involvement and participation
of all the parties and their advocates.

A neutral third party called "mediator" uses special negotiation skills and
communication techniques to help litigants bridge their differences and find a
solution to their dispute.

A Mediator does not decide what is fair or right, apportion blame or predict the
outcome in court. Rather, a mediator acts as a catalyst to bring the two disputing
parties together by defining issues and eliminating obstacles for communication
and settlement. Mediation always leaves the decision making power with the
parties.

04-07-2023- On this day of internship I had a visit to the VLC&SC Kangoo,


Block Nadaun, District Hamirpur, H.P. My objective is to observe the working
of the Para Legal Volunteer(s) manned in VLC&SC. I reached at the kangoo at
11 am. There I meet Para legal volunteers they give me some information about
VLC&SC like- VLC stands for Victims Legal Counsel. It is a service that
provides free legal help to victims of crime and those at risk of violence and
exploitation in the United States. VLC works with survivors to protect their
rights, safety, and well-being as they navigate the criminal justice system.

What type of legal services does VLC provide like-VLC provides legal
assistance in the areas of safety planning, access to resources, advocacy in court
proceedings, protection orders, guardianship/conservatorship petitions, filing
criminal complaints, restraining orders and much more.

05-07-2023- On this day of internship I had a visit to Court Of ld. District and
Sessions Judge, Hamirpur, H.P. My objective is to observe the court working
and have an idea thereof. I reached at the court at 10 am. The district and the
Sessions Judge was very nice person, very polite person. He is doing
questioning with the advocates. I got to know about the bail application under
Section 459 in Crpc. After that the judge said me to come to the front of him.
After that he ask me some questions like what is my name, from which
institution you are come from why you are here, and give me some advice to my
future.
