FINAL WRITTEN WARNING IN TERMS OF REGULATION 7(4) OF THE SOUTH

AFRICAN POLICE SERVICE DISCIPLINE REGULATIONS, 2016

You are hereby given a final written warning in terms of regulation 7(4) of the Discipline
Regulations, 2016, for misconduct.

The nature of the misconduct for which this warning is given is that you committed
misconduct:

by contravening Regulation 5(3) of the South African Police Service Discipline

Regulations, 2016, by committing an alleged misconduct as stipulated in regulation
5(3)(b)(iii) not complying with his duties and responsibilities, on 2024-02-19 @ 07:05
suspect namely Nkanyise Hlatshwayo, SAPS14/197/02/2024, was not charged and
you failed to release him as the 48-hour period had expired
AND
by committing an alleged misconduct as stipulated in regulation 5(3)(u) contravening
any prescribed code of conduct of the service, on 2024-02-19 @ 07:05 suspect namely
Nkanyise Hlatshwayo, SAPS14/197/02/2024, was not charged and you failed to
release him as the 48-hour period had expired. You thereby failed to uphold and
protect his fundamental rights.

Should you engage in further misconduct the final written warning may be taken into
account and it may result in further disciplinary action being taken.

The final written warning will be placed in your personal file for six (6) months from the
date of this warning. After the six (6) months period the final written warning will be
removed from your personal file and be destroyed.
