Rohit Vs. State

1) Applicant has filed this application for relaxation of condition of not

to leave Maharashtra State, imposed in bail petition in Crime No.I-110/2012
registered in M.I.D.C. Cidco Police Station, Aurangabad. Applicant contended that
he is innocent and falsely involved in the said crime. Allegations against the
applicant are that he tried to negotiate to purchase the property of informant
Dr.Ambekar. Applicant contended that he is released on bail and the court has
imposed condition that he should not leave Maharashtra State. Applicant is the
Chartered Accountant and is also partner in M/s.Sar and Associates which is
having office in New Delhi. Applicant is also having his relatives marriage at
Kanpur which is scheduled on 29th November 2012. Lastly he prayed that the
condition of not to leave Maharashtra State imposed in bail application may be
relaxed.

2) Say of A.P.P. and investigating officer called. A.P.P. submitted that till
filing of the charge sheet condition should not be relaxed. The investigating officer
submitted his say and gave no objection to relax the condition.

3) In support of application applicant has filed various documents

showing that he is partner of SAR Associates which is having office at Delhi. So
also applicant has filed pursis that he is not having passport. It seems that applicant
is Chartered Accountant by profession and he required to go out of Maharashtra
State for his professional work. There is no possibility of his being absconding as
he is not having passport. As contended by the applicant he required to go to his
relatives marriage at Kanpur scheduled on 29th November, 2012. Yet charge sheet
is not filed in the court. In these circumstances and in the interest of justice the
condition imposed on accused Rohit Ramnarayan Kumpawat for not leaving
Maharashtra State, in Bail Petition order in Crime No.I-110/2012 registered in
M.I.D.C. Cidco Police Station needs to be relaxed. Hence I pass the following
order :-
ORDER

1 Application is allowed.

2 Condition that the accused Rohit Ramnarayan Kumpawat

shall not leave Maharashtra State imposed in bail
petition order in Crime No.I-110/2012 registered in
M.I.D.C. Cidco Police Station, Aurangabad is hereby
relaxed.

3 Issue letter accordingly to the Inspector, M.I.D.C. Cidco

Police Station, Aurangabad.
