Sub:- Request to issue copy of detention order passed

in the name of my brother T.Senthilkumar Son
of Thiagarajan
 1. I am the sister of T.Senthilkumar Son of Thiagarajan aged
about 44 years and resident of Door No.5/30, VOC Street, M.A. Nagar,
Red-hills, Padianallur, Chennai – 600052.
2. I am given to understand that as per the G.O. No.SR.I/72-
21/2023, Public (SC) dated 17-11-2023 an order had been made by
the Government of Tamil Nadu under Sec.3(1)(i) under the
Conservation of Foreign Exchange and prevention of Smuggling
Activities Act, 1974 (Central Act 52 of 1974) directing that my brother
be detained.
3. I state that my brother Mr.Senthil Kumar is completed +2.
and he is running business of compressing sarees and dhothis for the
purpose of packing and exporting the same abroad at Thambu Chetty
Street, Chennai – 600 001.
4. I state that a notice dated 16-05-2023 issued by the 3rd of you
to my brother under sec.108 of Customs Act directing him to appear
for enquiry on 18-05-2023. The said notice was not served on my
brother, but the tenant in occupation of the building received the said
notice. On 01-06-2023 the 3rd Respondent searched the office of my
brother and seized the original passport and driving license of my
brother and other documents pertaining to my brothers business. But
the mahazar was not properly drawn and no copy of it was served. The
3rd Respondent included other articles which were not seized in the
office of my brother.
5. I state that another notice was issued on 14-08-2023 issued
by the 3rd of you under sec.108 of Customs Act to my brother (received
by the tenant in the said building) directing him to appear for enquiry
on 21-08-2023. But as per the legal advise, my brother filed
anticipatory bail petition in Crl.O.P.No.13160 of 2023 on the file of
Hon’ble High Court, Madras. In the said Crl.O.P. the 3 rd of you filed a
counter on 27-06-2023 stating as if on 08-05-2023 one Mr.Basheer
Ahamed son of Hyder Ali was intercepted on the way from Airport to
his house at Mosque Street, Hasthinapuram and 13.28 Kg. gold was
recovered from him based on his confession that my brother was one
of the investors my brother is also allegedly involved in the crime and
the Hon’ble High Court was pleased to dismiss the Anticipatory Bail
Petition on 25-09-2023. Once again my brother filed another
Anticipatory bail petition in Crl.O.P.No.1469 of 2024 on the file of
Hon’ble High Court, Madras and the said petition is pending. In the
said Crl.O.P. the 3rd of you filed a counter dated nil February 2024
stating as if detention order G.O. No.SR.I/72-21/2023, Public (SC),
17th November 2023 was passed and that the said detention order
could not be executed. Only on perusal of the said counter myself and
my brother came to know that the above detention order has been
passed.
6. I state that my brother is innocent and is no way connected to
the said offence of smuggling alleged to have been committed by
Mr.Basheer Ahamed. The said Mr.Basheer Ahamed is not known to
my brother and my brother did not have any contacts with him.
7. I state that my brother has been roped in by the 3 rd of you
with some ulterior motive and with a view to help the real culprits to
escape.
8. I state that the prevailing circumstances are not condusive for
my brother to appear before the 3 rd of you as there is a threat for his
life. Further if my brother is detained, he will be unable to defend the
false case foisted against him. Since the right of personal liberty is a
constitutional right, my brother is entitled to get a copy of the said
detention order in absentia, as there is a threat of detention if he
appears to receive the copy.
 9. I state that on 09-03-2024, I already sent a representation to
the 1st to 4th of you, requesting you to furnish a copy of the said
detention order. But till date I have not received the copy.
For the reasons stated above, it is requested that the 1 st and 2nd
of you may kindly furnish a copy of the detention order dated 10-10-
2023 along with booklet which has culminated in passing G.O.
No.SR.I/72-21/2023, Public (SC) dated 17-11-2023 to me being the
sister of detinue and as the detinue is unable to personally appear due
to the circumstances and reasons set out hereinabove and has
requested me to receive the copy on his behalf as im his next of kin.
