(i)Conduct of employees
- The conduct of employees of Better Prices, who failed to
report for duty on the first weekend of receiving instructions to
work on Saturdays and Sundays, can be described as non-
compliance or non-adherence to the company’s instructions or
policies.
Non-Compliant behavior involves the behavior that does not
conform to or follow the rules, regulations, or advice of others
in the workplace, this can be demonstrated by failure to act in
accordance with the workplace policies and rules, or the
inability to meet specified standards.
(ii)whether Better Prices is obliged to remunerate employees
who engage in the conduct above depends on the specific
circumstances and provisions of the employment contract, as
well as the applicable labor laws and regulations. Generally, if
employees engage in an unauthorized absence or strike, the
employer may have the right to withheld payments for the
period of absence. However, it is important to note that labor
laws in South Africa provide certain protection for employees,
and employers must follow due process and adhere to the
relevant legal requirements when dealing with unauthorized
absence or strike.
