INTRODUCTION
After the completion of 2nd Semester, as a law student, it was required to do an internship under
an advocate, or in an NGO. So I chose to apply under an advocate Mr. Sarbananda Sanyal who is
a good lawyer in civil matters. It was my first internship so I was a bit nervous and I was new to
the field. My in this internship I was mainly focused on reading different cases and analyzing
them.
The internship mainly acts as a bridge between the law degree and the practical implication of
law to become a lawyer. The internship also helped me to observe the good lawyers very closely.
INTRODUCTION TO THE PLACE OF INTERNSHIP
Adv. Sarbananda Sanyal is practicing at Calcutta High Court. He is in this field for the last 14
years. He also has a chamber in Chinar Park. There he consults with his clients. He is a civil-
based lawyer. He mainly deals with civil cases.

He guided me throughout the whole internship and made me understand how to analyze the
cases and how it’s dealt with.
Daily Internship Duties

During my internship duties, I was assigned various cases. I read the cases with my full
dedication and analyzed them.

I read various judgments and assisted my senior advocate with different cases and managed the
cases. I also helped in organizing the paper works and other court works.

The Fact of the Case: The petitioner and the proforma opposite party bought 4 floors but
they were always told by the developer that no illegal construction took place and no legal case
is pending before any authority. But it was unknown that it was a refugee land gifted by the
Government of West Bengal known as a colony land. But the petitioner and the proforma
opposite party received a photocopy of the order of The Special Officer (Building) dated
17.06.2023 and it was stated that the whole building will be demolished within 30 days. But the
petitioner and the proforma opposite party appealed for an interim order of stay till the disposal
of the aforesaid appeal.

Legal issue: The petitioner and proforma opposite party went to the Municipal tribunal for the
stay of the order but it was refused and later they went to the High Court for the appeal.

Current position of the case: The high court granted the stay and granted to file the appeal.

Case 2
Name of the case: Saifal Sk. V. The State of West Bengal (W.P.A No.
2368 of 2022)

Plaintiffs/ Opposite Parties: The State of West Bengal
Facts: The land was inherited by the plaintiff after his father’s death. But he noticed that
his uncle when his father was alive took advantage of his father’s illiteracy and recorded
his name in the said plot. The plaintiff then went to lodge the complaint in the local
police station, but the local police didn’t take any steps. The defendant constructed on the
land without any sanctioned plan so under the Panchayet Act such construction is illegal.
So the plaintiff appealed for the demolition of the construction.
Legal Issue: Filing for an injunction so that no further illegal construction is taken
place.
Current position: An injunction was passed over the construction as no sanction plan
was there which is illegal under the Panchayet Act.
Case 3: Nitya Gopal Ghosh v. State of West Bengal & Ors.
(W.P.A 2349 of 2021)

Defendant: State of West Bengal
Facts Of the case: The land was acquired by the National Highways from the
plaintiff but no proper compensation was given to the plaintiff.
Present Scenario: The High Court asked for the report from the National Highway
but the report is not yet provided by the National Highway and its pending before the
court. No report is not yet provided by the National Highway.
Case 4: Mukberia Estate v. State of West Bengal and Ors.
(W.P. No. 12109 of 2022)
Plaintiff: Mukberia Estate
Defendant: State of West Bengal
Facts of the case: The land was acquired for making a holiday home. The land was in
Puri but for this purpose, it was taken but it was not fulfilled. The plaintiff filed for the
stay.
Legal Issue: The land for which the land was acquired was not fulfilled.
Current position of the case: The case is pending before the High Court for the
same.
Case 5: Tulika Biswas v. State of West Bengal and ors.

Defendant: State of West Bengal
Facts of the Case: The National Highways acquire the land for the plaintiff for
construction but not the proper compensation was provided to the plaintiff. So the
plaintiff filed for the proper compensation before the court.
Legal Issues: Filed for the proper compensation.
Current position: The case is pending before the High Court at Calcutta.
Case 6: Bijon Bihari Dhar v. Parul Mallik
(F.A. No. 2 of 2013)
Plaintiff: Bijon Bihari Dhar
Defendant: Parul Mallik
Facts of the Case: A letter of Administration Probate in favor of the two sisters that is
the defendant and the adopted son Bijon Bihari Dhar challenged the will in the High
Court.
Legal issue: Challenging the Letter of Administration
Current Position: The case is pending for the final adjudication of the letter of
administration.
Case 7: Samiran Karati v. Howrah Municipal Corporation & ors.
(W.P.A. 25420 of 2022)
Plaintiff: Samiran Karati
Defendant: Howrah Municipal Corporation
Facts Of the case: The plaintiff was the owner of the premise where the defendant
was making illegal and unauthorized construction without any proper sanction to build a
proper plan. Because of the construction, there was an obstruction in the natural light and
air which was causing a nuisance. The plaintiff made several representations to the
corporation but there was no effective result.
Legal issue: The plaintiff wanted the demolition of the building.
Current position: Hon’ble court passed for the demolition of the building as there
was no proper plan for the construction of the building.
Case 8: Md. Mazahar Ali & Anr. v. Tapan Nayek & Anr.
(C.O. No. 3433 of 2022)
Plaintiff: Md. Mazahar Ali & Anr.
Defendants: Tapan Nayek & Anr.
Facts of the case: Plaintiffs filed for the declaration of Khas possession and
permanent injunction against the defendants. According to the plaintiff, there was some
error in the records of the quantum land.
Legal issue: The plaintiff filed for a local investigation to prove the encroachment of
the suit property.
Current position: The High court passed the order for local investigation.
Outcome Learnings
After reading the cases I am able to understand the various cases. Now I will be able to
make the facts of the case.
By reading the cases I came to know about Affidavit and the vakalatnama where the
client gives the power to the advocate to present the case on his behalf.
It also helped me to know various case proceedings.
