As per note, the appeal has been preferred after 19 days of it's limitation
The appellant had complied with Second Proviso of Section 15 of The Consumer Protection Act,
1986 (in brevity "The Act of 1986").
To condone the delay, the appellant had filed I.A. No.1/2019, duly supported by an affidavit.
For the reasons mentioned in I.A. No.1/2019 and arguments advanced, we are of the considered
view that the appellant had satisfactorily explained the delay of 19 days occurred in filing this
appeal. Consequently, we hereby allow I.A. No.1/2019 and condone the delay of 19 days occurred
in filing this appeal.
Heard on admission.
At the outset, learned counsel for the appellant would submit that as they had not received any
claim duly filled in along with entire formalities and documents, they could not decide the said
claim on administrative side. Even if the complainant submits necessary documents and completes
formalities, they may consider the grant of claim under the terms and conditions of the policy,
hence prayed that though the dispute was not ripe, the concerned District Forum heard and decided
the matter. Also submits that they are not in receipt of final bill from the complainant.
Perused the impugned order dated 27.08.2019, passed by the District Consumer Disputes
Redressal Forum, Bilaspur (C.G.) (in brevity "District Forum") in Complaint Case

On payment of necessary P.F. within 7 days from now, let notice be issued to the respondents
through registered A/D post returnable along with copy of Memorandum of Appeal and documents
annexed.
