All Filipino children in the Philippines are protected from all sorts of violence, abuse,
exploitation, and discrimination. This Act strengthens deterrence and provides further protection
against child abuse, exploitation, and discrimination. When a parent, guardian, teacher, or other
person with care or custody of the kid fails or is unable to protect the child from abuse,
exploitation, or discrimination, the state must intervene on behalf of the child. Furthermore, the
State's policy shall be to protect and rehabilitate children who are badly threatened or endangered
due to conditions that impact or will influence their survival and normal development.
Child abuse has been defined in this act. Accordingly, it refers to the maltreatment,
whether habitual or not, of the child which includes any of the following: (1) Psychological and
physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment; (2) Any act by deeds
or words which debases, degrades or demeans the intrinsic worth and dignity of a child as a
human being; (3) Unreasonable deprivation of his basic needs for survival, such as food and
shelter; or (4) Failure to immediately give medical treatment to an injured child resulting in
serious impairment of his growth and development or in his permanent incapacity or death.
and the Department of Social Welfare and Development in coordination with other government
agencies and private sector concerned, to protect children against child prostitution and other
sexual abuse; child trafficking, obscene publications and indecent shows; other acts of abuse;
prostitution or subjected to other forms of sexual abuse while the victim is under the age of
twelve (12) years shall be prosecuted under Article 335, paragraph 3 of Act No. 3815, as
amended, the Revised Penal Code, for rape or lascivious conduct. While anyone who engages in
child trading and dealing, including, but not limited to, the act of purchasing and selling a child
for money, or for any other payment, or barter, may face the punishment of temporary to
permanent reclusion.
