Depariment of the Interior and Local Government e NATIONAL POLICE COMMISSION Makati City MEMORANDUM CIRCULAR NO. 202-011 by OPERATIONALIZING THE PARTICIPATION OF LOCAL CHIEF IN THE ADMINISTRATION OF THE PHILIPPINE NATIONAL POLICE (PNP) AS. PROVIDED FOR UNDER REPUBLIC ACT NO, 6975, AS AMENDED WHEREAS, pursuant to Section 51 of R.A. No, 6975,as-amended by, Sections 62 to 64 of R.A. No. 8554, local chief executives have been granted, subslanyjal"poWers and responsibililies in police administration, as follows: MONIES n A. POWERS te 1. Operational Supervision and Contror “UCL Ly 2h . “City and Municisal élayors. ~ (1) Operational Supervision and Control. The cily and municipal mayors shall exercise operational supervision. and contro! over PNP units in their respective jurisdictions except during the hirty (20) day period immediately preceding and ‘the thirly (30) days fallowing any national, local or barangay elections. During the said period, the local police forces shall be under the supervision and control of the Commission on Elections.” (Section 51 (b)(1), KA. No. 6975) “The term ‘operational supervision and control’ shall mean the power te direct, superintend, and oversee the day-to-day functions of police investigation of crime, crime prevention activities, and Wraffic control in accordance with the sulos and fegulalions promulgated by the Commission." {Seclion 62, R.A. No, 0554) “The contral and supervision of anti-gambling operations shail be within the jurisdiction of local government executives.” (Svution 63, R.A. No. 8551) Authority To Exercise Adiinistrative Disciplinary Powers “Administrative Disciplinary Powers, — In the areas of discipline, city and municipal mayors shall have the power to impose, after due notice and summary hearings, disciplinary penalties for minor offenses committed by members of the PNP assigned to their respective jurisdictions, as provided in Section 41 of this Aci.” (Section 51, (b)(3), FLA. No. 6978) 3. Authority To Choose the Chief of Police “Authority (o choose the chief of police from a list of five (5) eligibles recommended by the provincial police direcior, proferably fram the same province, cily or municipality: Provided, however, ‘Thal in ne case shall an officer-in-charye be designated for more than thirly (20) days: Provided, further, ‘That the local peace and order council imay, through the cily or municipal mayor, fecomniend the recall or reassignment of the chief of police when, in its pesceplion, the Jailer bas Leen ineffective in combating crime or maintaining peace and order in the city or municipality: Provided, finally, That such relief shall be based on guidelines established by the Napoicom.” (Section 63 (4) (i), RA No. 8551) ,) 4 WW ve “ 4. Authority To Recommend Appointment of New PNP Members “Authority lo recommend from a list of eligibles previously screened by the peace and order council he appointment of new members of the PNP to ba assigned to their respective cilies or municipalities without which no such appointments shall be attested: Provided, Thal whenever practicable and consistent with the requirements of the ‘service, PNP members shall be assigned to the cily or muuricijyality of their residence.” (Section G3 (4) (ii), RA No. 0551) Authority To Recommend ‘The ‘Hansfer, Reassignment or Detail of PNP Members. "Authority to fecommend {0 the provincial director the transfer, feassignmnent or detail of PNP niembers outside of their respective city or town residences.” (Section 63 (4) (ii), RA. No, 8551) 6. Authority To Conduct Inspection and Audit "As dgpulized ayents of Ue Commission, fucai government execulives, can inspect police forces and units, conduct audit, and oxercise ather functions as “may be duly authorized by the Commission.” (Section 64, R.A, No. 8551) B, RESPONSIBILITI 1) Responsibility To Develop an Integrated Area/Community Public Safely Plan "Integrated Community Safely Plans. - The municipal/city mayor shall, in coordination with the local peace and order council of which he is the chairman pursuant to Executive Order No. 309, as amended, develop and establish an inlegraled area/community public safoty plan embracing prigrilies of action and program thrusts for implementation by the local PNP stations." (Section 51 (b) (2), R.A. No. 6975) | j 2) Responsibility Te Sponsor Periodic Seminars for PNP Members “It shall, likewise, be the duty of the city or municipal mayor to sponsor periodic seminars for members of the PNP assigned or detailed in his city or municipality in order to update them regarding local ordinances and tegislations.” (Section 51 (b) (2) para 2, R.A. No. G975) WHEREAS, under Section 34, R.A. No, 6975, the appointing authorities for police non-commissioned officers (Police Officer | te Senior Police Officer IV) are the PNP Regional . Directors for the regional personnel, and the Chief, PNP for the national headquarters personnel, Police commissioned alficers (Inspectors to Superintendents), are likewise appointed by the Chief, PNP. The President is the appointing authority for Senior ‘Superintendents and higher ranks; WHEREAS, effective police administration al the Jocal level requires a clearer delineation and operationalization of the aforementioned statutory powers of local chief executives; yr v gi Ww NOW, THE! THE COMMISSION HAS RESOLVED TO PRESCRIBE, AS IT HEREBY PRESCRIBES the following guidelines in the exercise tof the aforementioned powers by local chief executives: A 1 Power of Operational Supervision and Control. - The power of operational supervision and control pertains to the authority to uirect, superintend, and oversee the daily performance of police functions at the local level te ensure the effective conduct of crime investigation, affic contro! and crime prevention activilies. (Sec. G2, R.A, No. 8551). In pursuance thereto, City/Municipal Mayor is empowered tu a. Issue directives for the cunduct uf operations (u stop illegal activities and neutralize criminal syndicates especially those engaged in kidnap-lor- ransom, illegal drugs, bank robberies, anu illegal gambling, b. Determine operational strategies lo be adopted lo ensure efficient and affective accomplishment of police operations, Direct the employment and deployment of units or elements of the PNP, through the station commander, to enswe public safely and effective maintenance of peace and vider within the fucalily. Assess and evaluate the overall effectiveness of the police station as well as the overall porformance of the Chief of Police and fumist the Napolcom Regional Director, the PNP Provincial Director and the Governor with copies of the evaluation report. For the National Capital Regivn, the City Mayors of Manila and Quezon shall fumish the Napolcom NCR Regional Director, National Capital Region Police Office (NCRPO) Director, Western Police District Director and the Central Police District Director with copies of the evaluation report on the overall effectiveness of the concemed police district offices of the Western Police District and Central Potice District. For cities and municipalities other than Maja and Quezon, the Mayors shall furnish the Napoleom NCR RegianaMDirector, NCRPO Director, Police District Directors and concemed Chief of Porice with copies of their evaluation wears ‘on their respective police stations, ie! pw | a ey Qh | 54 f. Authority to Choose the Chief of Police — In the exercise of the authority to choose the Chief of Police in his locality, the City/Muricipal Mayor shall be guided by the following: a, “Qualitications of Chief of City and Municipal Police Stations ~ No person shall be appointed chief of a city police station unless he/she is a graduate of Bachelor of Laws or has finished all the required courses of a master’s degree program in public administration, criminology, criminal justice, law enforcement, national security administration, defense studies, or ary other related disciplines from a recognized institution of learning. No person shall be appointed chief of a municipal police. station unless he or she has finished at leas! second year Bachelor of Laws or has earned at least (welve (12) units in a master's degree program in public administration, criminology, criminal justice, law enforcement, national security administration, or any other relaled disciplines from @ recognized institution of learning: Provided, ‘That members of the Dar with at least five (5) years of law practice, licensed criminologists or graduates of the Philippine National Police Academy and who possess the generat qualifications for initial appointment {o the PNP shall be qualified for appointment as chief of a city or municipal police station: Provided, further, ‘Thal the appointee has successfully passed the required field training program and has compiied with other requirements as may be established by te Commission: Provided, furthermore, That the chief of police shall be appointed in accordance with the provisions of Section $1, paragraph (b), subparagraph 4 (i) of R.A. No. 6975." Regional Direclor fur immediate transmittal to the Cily/Municipal Mayor for hi to sélect the Chief of Police of the cilyiwunicipality, within five (5) working days from receipt the! eof If any of the submitied recommendees is not qualified for assiynmenWdesignation a8 Chief uf Police in accordance wilh existing laws and regulations, the Napolcom Regional Director, within five (5) working days from receipt of the list. shall return the same to the PNP Provincial Director/District Director through the PNP Regional Director staling therein the reason(s) wilh the specific instruction to replace ungyalilied recommendee(s) with qualified officer(s) Within five (5) working days from receipt of the list of the five (5) 1ecommendees, the Cily/Municipal Mayor shall evaluate and signify his/her choice of Chief of Police in wriling to the PNM: Provincial Direclor/District Director, who shall, thercupon, issue the Order of Assignment j Should Ihe Mayor fail to choose (e COP from among the five (5) recummenuees within the prescribed five-day period, he shall: | 1) return within five (5) wurking days the list/folders to the PNP Provincial Direclor/District Direclor stating spe feasons for his ner-setaction of the oe \ ewe COP for Highly-Urbanized Ci 2) requiie the PNP Provincial Director/District Director to submit a replacement fist within five (5) days irom receipt thereof, 3) recunmiend the designation of a qualilied Officer-in- Charye (OIC) for a perivd nol to exceed thirly (30) days. Should the Mayor fail to select from the replacement list, the Mayor or the PNP Provincial Directur/District Director shall elevate the matter to the Napolcom Regional Director stating their reason(s) for non-solection. The Napotcom Regional Director shall resolve the conflict within five (5) days from receip! thereol, The decision shalt be immediately execulory unless appealed to the Commission en banc for resolution within five (5) days The PNP Provincial Direclor/District Director shall furnish the Mayor, PNP and Napolcam Regional Director copies of the Order of Assignment of the Chief of Police or the Designation of the OIC, as the case may be, (See Figure 1) $ and Independent Component Cities, Including the District Director of the Cilies of Manila and Quezon a) The PNP Regional Director shall submit within fifteen (15) days before the expiration of the lour of duly of the incumbent Chief of Police, the list and personal information folders of five (5) qualified eligibles to the Napolcom Regional Director for review of qualifications and eligibility. In cases where the relief or reassignment of the incumbent Chief of Police is urgently required by neous of the service or reinsialed 19 maintain the integrity of the police station before the expiration of his tour of duly, the Regional Director shall subinit, within five (5) days after the relief or reassignment, a list and personal information folders of five (5): qualified eligibles lo the Napolcom Regional Director, for review and confirmation within five (5) working days from receipt thereof: Provided, (hat the Depuly Chief of Police shall perform the functions of the relieved COP unlil the new COP or OIC has been designate, The Napolcom Regional Director, within five (5) working days, shall evaluate the qualifications and eligibility of the recommendees and return the list and folders lo the PNP Regional Director. Should the Napolcom Regional Director find that any of the recommendees in the list does not meet the qualifications and eligibility, he shall selurn the list to the PNP Regionat Director stating therein the reason(s) with the specific instructivn to replace unqualified recommendee(s) with, x jualiiod ofcerta).
