According to the Oxford Dictionary ‘profession’ comes from the Latin profesionem which means making a public deciaration, which came to mean taking @ vow or cath, on entering a learned occupation. We frequently associate professional groups with notions of expertise, status and power. A good example was the action of the American Psychiatric Associations in 1974, when by a majofity vote in their convention they decided that homosexuality was no longer an iliness. This shows the great power that professional organizations have in defining our social reality. The fact that certain occupational groups have such enormous power over their areas of expertise is a cause for concern. We immediately should ask - how did these groups amass this power? What kind of controls does the public have in the exercise of this power? ‘There is an assumption in our society that lawyers are professionals. Such an assumption avoids the question of why lawyers may legitimately call themselves professionals. When we think of the traditional professions, lawyers and doctors immediately come to mind. In medieval times being a priest or a soldier would have been considered a profession but fow would think of them as such today. During the fourteenth century, surgeons who have high status today, came after the barbers in the guild parades, which reflected their relative status. For centuries the clergy and the military were considered professions and suitable occupations for the chikiren of the upper class. Today we do not think of the clergy nor the military as professionals. There is therefore historical evidence of the rise and fall of the status of occupations. So how did the present professionals obtain their status and extraordinary powers over the area of their ‘expertise? The modem legal profession finds its historical origin within the church. For hundreds of years the role of education was tied to ecclesiastical functions. The main source and disseminators of knowledge were the priests. Lawyers, like priests were among the few groups in medieval society who had the ability to read and write. Since few had these skills. lawyers became an important reservoir for the accumulation of knowledge. The transmission of this knowledge was limited. It took centuries after the invention of the printing press by Gutenberg in the fifteenth century, for printed information to become readily available to themasses. The identification with the clergy was clearly recognized by Voltaire, the famous eighteenth-century French philosopher, poet and dramatist, who said: “la Jol, n'ost pas une profession, c'est un sacerdose'- the law is not a profession, itis @ priesthood. 1.
