Additional Price Information and Conditions
PRICES
All prices stated above are in US Dollars and calculated based on the exchange rate average of December 2021 (Euro/USD).
AIR SUPPORT reserves the right to adjust the prices accordingly and without warning, if the decline in exchange rates is greater than 15%. Any exchange
rate variation greater than 15% between the quoted exchange rate shall be applied to the Buyer’s account resulting in an extra cost.
All prices stated above are excluding Danish VAT. For all Danish customers and for customers within the EEC countries without possession of a valid
VAT registration number the Danish VAT automatically applies. Danish VAT does not apply to customers outside the EEC countries and to customers
inside the EEC if they present a valid VAT registration number.
GENERAL TERMS AND CONDITIONS
The General Terms and Conditions applying to USER are described in the GENERAL TERMS AND CONDITIONS section which are an integrated part
of the Commercial Software Licence Agreement.
TERMS OF DELIVERY
AIR SUPPORT´s general delivery terms for PPS program software solutions are:
DAP – Delivered at Place (and all taxes unpaid), Incoterms 2020
All software module and service charges under this Agreement and as stated in the PPS Standard Price List include all eventual shipping and physical
delivery costs to USER´s address including any needed hot-line telephone support in connection with installing software module or service upgrades.
Installation visits are excluded unless agreed specified and signed in writing between the parties.
The delivery terms specifically include postage, transport and all related physical shipment costs prepaid to USER but do not include any applicable
customs clearance costs, customs duty charges, local value added tax, software tax, income tax, double taxation agreement regulation tax, withholding
tax or any other type of tax or charges issued by local authorities in USER´s country concerning the software delivery or services supplied under this
Agreement. If such taxation or charges apply to either USER or SUPPLIER in USER´s country concerning the software solution or services supplied
under this Agreement, USER shall carry the initial responsibility to pay such taxation or such charges separately and in all cases to hold harmless
SUPPLIER in relation to the agreed payment amounts and payment terms under this Agreement.
AIR SUPPORT´s general delivery terms for program Upgrades and Update services are as follows:
Free delivered Destination excluding any kind of tax or duty or charges
TIME OF DELIVERY
For a new PPS User, unless online delivery is agreed, or statement of work is included in delivery, any agreed on-site main-installation visit is guaranteed
to take place in USER’s offices within 5 to maximum 8 calendar weeks from the time USER has signed the Software Licence Agreement and AIR
SUPPORT has received all aircraft performance data as requested along with USER’s initial order pre-payment has arrived in AIR SUPPORT´s account.
Longer delivery time may occur during holiday seasons or other unforeseen situations arising from extraordinary events.
