One month. That's how long it's been since I sent a records request to the Grand County Sheriff's department. Although I still have not obtained any of what I requested, I've learned enough about the law enforcement arm of our county to be able to tell you with confidence that they write the rules as they see fit. In fact, I can say with certainty the Sheriff's department is even willing to break the law in order to hide what, to most, would look to be an obvious abuse of power. I've been receiving numerous complaints about our sheriff. But one person's plight, in particular, caught my attention. Although it may seem unbelievable, I look at everything I cover from both sides of the table. I believe it takes two to tango, and the truth of two stories almost always ends up somewhere in between. That dynamic becomes slippery when one of the parties in the story is a law enforcement officer or officers. It becomes even more slippery when that status is used in a onesided, subjective manneryet that appears to be just the case. This is a story of two landowners in the west end of the county who are having a feud. That's a story as old as land ownership itself. When people have disputes they can't reconcile by themselves, the law is consulted for a remedy. This usually involves a call to the sheriff. Now, my view is that there's no bad situation the police can't make worse, but sometimes there's just no other alternative. In that case, the sheriff will send a deputy to investigate. It is the deputy's job to gather evidence and take statements in an objective, non judgemental manner. It is not the job of law enforcement to determine guilt or innocencethat's for the courts and juries. Unfortunately, that's not how our sheriff operates. After speaking with this rancher, I definitely wanted to find out the whole story. I contacted the sheriff's department to obtain copies of all of the incident reports related to these particular parties. I received a response a couple of days later asking for clarification of what I was looking for. After sending my note, I received another response: "Reggie, after working on your request for over a week the cost is going to be fairly expensive. It's going to be a minimum of $500.00 and could exceed a thousand or more. Do you want me to proceed in gathering the rest of the records?" My response? "First off yikes! Is there any way to get a breakdown by type of file, number and cost? If I end up having to spend a grand on this, I would like to have a bit better information about what I'm paying for. I'm assuming this is a computer/file search with associated printing costs? If so, this must be a doozy." One thing you should understand is that I expected one of two outcomes to my records request. Either the sheriff's department would immediately respond with a reasonable cost associated with the records involved, or they would stonewall me.

When you don't want someone to know something, you stonewall. And that's just what's been happening for over a month now. Now that it was obvious I was being put on, I called around to other sheriff's departments around the state in order to find out what they charge for records. I even spoke with one internal affairs investigator who was quite perplexed at the amounts involved for the records I was requesting. The Jefferson County Sheriff charges five dollars for each police report up to 10 pages. They charge 10 cents a page thereafter. That's pretty standard across

"I was a little taken aback by the cost of the records I requested, so I contacted a few other Sheriff's departments here in the state to make a comparison. One internal affairs officer, off the record, definitely spotted some red flags. As an example, the records department at one Front Range sheriff's office charges $5.00 per case report up to 10 pages, with a .10 cent charge per page thereafter. That would mean I requested 200 case reports and/or 10,000 pages of copy! I asked for a worstcase scenario, and none of the deputies or clerks I spoke with thought even $500 dollars was a reasonable charge for the records I requested. Let's just say the Grand County Sheriff's department has raised some eyebrows around the state. Would you mind giving me a detailed explanation of the costs associated with the records I requested?" A day later, I received this response from Undersheriff Campbell: "Mr. Paulk, I received your email concerning the charges for your records request. At this time our charges as listed on the Fee Schedule are as follows. Police Reports and other official Grand County Sheriffs Documents are charges at $1.25 per page with a minimum of $2.50. Research and Copying charge is $15.00 and then $10.00 per half hour after the first half hour. Considering these rates your request at this time is figured as follows. Research and Copying at 1.5 hours which would be $45.00. Report pages of 375 at $1.25 per page $468.75. This includes 27 reports. At this time the total cost is $513.75. However this may not be all the reports that you have requested. Please feel free to contact me with additional questions." In Jefferson County, my request would cost about $145. That's a little high, but certainly not in the $500 to $1,000 range. A chance phone call about my predicament led me to Colorado Statues concerning the amounts local agencies may charge for records requests. This led me to Senate Bill 07045, which was signed into law in 2007. According to this law, our sheriff may not charge more than 25 cents per page for noncertified records. Oops! I decided to make a few more phone calls to local attorneys in Grand County to see what they get charged for these records. What I found out paints our sheriff in a very bad light. Continued

You want to actually resolve what's facing our nation? Then you need to do two things, and only two things. One you will like, one you will not. But if you only accomplish half, you accomplished nothing. Restore the Rule of Law. We're a Constitutional Republic, not a Democracy. In a Democracy the 51% enslaves everyone else. Are you black, hispanic, or some other minority? In a democracy you're a slave. Recognize this or make a huge mistake supporting any such move. A Constitutional Republic is governed by the Rule of Law, which says that nobody gets to infringe your fundamental liberty interests, no matter who they are: Rich, poor, white, black or Martian. Everyone who breaks the law is punished and for like crime one gets a like sentence. If I rob you of $50,000, whether I do it with a gun or briefcase is immaterial. Whether I take it one penny at a time or all at once is immaterial too. In each case I must go to prison for doing it and what I stole must be returned to the maximum extent possible. Recognize that mathematics does not permit compound growth on a permanent basis. It cannot happen, therefore it will not happen. Any claim that it can or will is a violation of the law as it is an intentional fraud. This means that those who were "promised" pensions predicated on 8% growth were robbed. It means those promised Medicare (with medical care going up at 9% a year in cost) were robbed. It means that the growth of debt at a rate exceeding that of growth in the economy could not possibly be sustained on a permanent basis and every claim based on that was a fraud, including home price appreciation, stock price appreciation and more. That's it. Recognize both of those two facts above and you've got a way to solve what ails this nation. You have a path forward. You have a path to truth. If you fail to do this you have no path forward. You have no truth. You do not have anything that is sustainable and you are a participant in a ponzi scheme. When you claim there is a "moral imperative" to provide that which is impossible you're wrong. Not only is there no such imperative demanding that which is impossible is in and of itself immoral as you can only achieve what you seek by robbing someone else. Wake up America. Our politicians love to divide into left and right because then we don't demand the truth, which is found in just two foundational principles as noted above. Everything else (literally everything else) is a worthless debating tactic as it is not possible to achieve what is being allegedly sought. You can temporarily steal from one person to pay another but when you are dealing with an exponential system even this does not succeed in the long term as eventually the money you seek to acquire from others exceeds the total amount of money available. There are two and only two options available to us as Americans. We can accept these facts or we can continue to play political games and our economy and political system will collapse. This is not conjecture, it is a mathematical certainty. In short, we must grow up.

state statutes concerning document charges specifically mention journalists as parties that may be charged less than the prevailing rate in their line of work. I guess I don't qualify. Nowhere do the statutes mention preferential pricing as a way to avoid having to dispense records. Since Campbell said I could ask qeustions any time, I took him up on his offer: "Mr. Campbell, Would you mind looking at Senate Bill 07045 and then sending me an amended list of charges for the requested documents? I'll let you know if I do. In the meantine, I've also asked some other questions based on a few police reports I was able to obtain independently: "In light of the research and documentation fees you quoted me, I've obtained records separately from the Sheriff's office. I will start off by saying that Grand County needs to review its fee schedule. My calls to other sheriff's departments with regard to records requests revealed that Grand County charges nearly 200 percent more than they do. I find this to be unacceptable. That being said, I would like to fact check a couple of incident narratives I've obtained. If you look to Incident Narrative 09000736, deputy Robert Florquist refers to a handgun that was turned back into the sheriff's department by Jack DiCola. Sheriff Johnson mentioned that he'd like to ask the courts to forfeit the gun so it "could be disposed of." Is it standard practice of the Grand County Sheriff to dispose of evidence before trial? Further, is it standard practice to dispose of property that does not belong to the accused? The next question is related to the question above. I've asked but never received a response to this. What is the disposition of the .50 caliber rifle used in Marv Heeymeyer's rampage through Granby? It's my understanding this weapon is still in evidence and is still fired occasionally by employees of the county and sheriff's department. If it is not, could you let me know the date

the gun was removed from evidence and destroyed? Please refer to Incident Narratives 09001043_1 and 09001043_2: Could you please clarify the relationship Sargeant Pamela Peschiera had with John Coors on September 28th, 2009? Is she a resident on his property, employee or both? If either of these relationships is true, could you then describe to me how it's possible for her to be filing charges and/or incident narratives when there is a clear conflict of interest? Further, if there is indeed a relationship, I would like clarification on how it's possible for a private citizen (Coors) to receive the benefit of a personal sheriff's deputy on the public's dime. Is it standard practice of the Grand County Sheriff's department to search for nine hours for bullet fragments in cases of vandalism? How does your office handle county road signs that have bullet holes in them? Please refer to Incident Narrative 090011151: Sargeant Pamela Peschiera is listed as both the complainant and reporting officer. Seriously? There is obviously an ongoing and escalating feud between Mr. Coors, Sargeant Peschiera and Mr. Miniat that much is clear. What is disturbing in this instance is what looks to be a clear breach of ethics and collusion on the part of the Grand County Sheriff's department with regard to handling this matter. I look forward to your response." I haven't received a response to this email either, and I've given sufficent time to do so. Unfortunately, in the court of public opinion, silence is often just as much an admission of guilt as an outright confession. So what conclusions may be drawn here? It's obvious the integrity of our sheriff's department is compromised. With regard to records fees, I was quoted bogus fees in order to dissuade me from pursuing the requested records. If the sheriff was charging other parties the same amounts as I was quoted, we could maybe overlook this as a law that wasn't followed for the last four years. As it stands, it's quite obvious the sheriff does not want me to have these records, and will go so far as to not follow the law to prevent me from obtaining them. It also means that anyone who paid more than .25 cents per page over the last four years should have their money returned. I gave the sheriff the benefit of the doubt. I was going to obtain the records and then have a meeting with him and his deputies personally in order to ask the questions they brought up. Unfortunately, a month has passed with very little progress. It's time for Grand County's citizens to decide what to do next. We must demand a higher standard of conduct out of our sheriff and his deputies than what could be expected of average citizens. They've taken an oath to uphold the tenents of the Constitution. A deputy who violates a citizen's right to life, liberty and the pursuit of happiness has no place in law enforcement.
