PLAINT FILED UNDER ORDER VII RULE 1 OF CPC

1. The Plaintiff is Mrs.L.Bhavani, W/o.Lasar, aged about 32

years, residing at No.38, 1st Floor, Jagan Nagar, Vichoor, Manali

New Town, Ponneri – 600103.

The address for the service of all notices and summons is that of

his counsels M/S.D.YOGESWARAN (E.No.2105/2009) Mr.P.KANNAN

(E.No.466/2009) Mr.C.MUTHUKUMAR (E.No.67/2020) and

Mr.S.A.MOHIDEEN PARK (E.No.4295/2022) having their office at “D&D

ASSOCIATES” No. 20/33, Victory Group of Institutions Building, 1st

2. The Defendant is Mrs.S.Sharmila, W/o.Saranraj, aged about 30

years, residing at No.27/20, Anjaneyar Koil street, Manali New Town,

Edayanchavadi, Ponneri – 600103.

The address for service of summons, notices, process on the


above named Defendant is that of the same as stated above.

3. The Plaintiff submits that she is residing at above mentioned

address and she is a single mother who is separated from husband and

living alone with her male child. The Defendant is known person to the

plaintiff for several years and both are residing at same locality. In the

month of October 2024 the Plaintiff asked handloan from the defendant

for her son’s emergency medical expenses and the defendant also

gave Rs.2,00,000/- (Rupees Two Lakhs only) at various occasions.

4. The Plaintiff further submits that the defendants asked exorbitant

interest rate of 10 persent per month for the handloan she gave to the

plaintiff and the plaintiff also without any other option accepted for the

same. In the month of November 2024 the defendant pledged her

jewels in her name and gave Rs.1,68,000/-(Rupees One Lakh and

Sixty Eight Thousand only) to the Plaintiff. The Plaintiff also asked 6

months’ time repay the said hand loans and the defendant also

accepted for the same.

5. The Plaintiff submits that the defendant suddenly in the month of

December 2024, compelled the Plaintiff to repay the entire amount

within the few days. The Plaintiff clearly mentioned at the time of

receiving the amount that she cannot repay the said amounts in short

period and she needs minimum 6 month time to settle the above said

loans. But the defendant created a big quarrel with the Plaintiff and

threatened the plaintiff and gave a complaint in M7 Police station in the

mother of December 2024.

6. The Plaintiff further submits that due to the compulsion of the

defendant, the Plaintiff borrowed some money with some other persons

for higher interest and gave Rs.50,000/- (Rupees Fifty Thousand only)

at Police station before Police authorities and gave undertaking that

within the period of 6 months’ time from that date, she will close the

hand loan. But after received the part payment and went accepted for

the time, again she started to torture the plaintiff to settle entire loan

amount immediately.

7. The Plaintiff further submit that the Plaintiff explained her situation

clearly to the defendant and her husband but both of them is not in a

situation to hear anything from the plaintiff and scolded the Plaintiff in

abusive language and also they have sent some of the rowdy elemen
ts to the Plaintiff’s house and threatened her to vacate her from house

and lock the premises. The Plaintiff went to the Police station and they

also not responding anything properly and they also told to settle the

loan amount immdeately to the defendant, so the plaintiff with no

alternative relief approached this court.

8. The Plaintiff further submits that without any other alternate remedy

except to move before this court of law she is approaching this Hon’ble

court by the way of filing this suit for granting permanent injunction

restraining the defendant her men, agents, subordinates or anybody

under her in any manner from interfering or entering or disturbing

the Plaintiff peaceful possession of the suit schedule property

under the guise of collecting money without due process of law.

9. The Plaintiff submits that the balance of conveniences is in

favour of the Plaintiff and prima-facie she has got the good case and

further the defendant got no right to whatsoever take law in her hands

and if she has been allowed to carry on with this threat serious

prejudice and irreparable loss will be caused to this plaintiff whereas

no prejudice or loss will be caused to the defendant if he is restrained

by the order of this Hon’ble court.


10. The plaintiff values the suit for the purpose of court fee and
jurisdiction as follows:

For Permanent Injection is valued at Rs. and pays court

fee Rs. - under section 27 (c) of the Tamil Nadu Court fees and

suits valuation Act -1955.

Hence it is therefore prays for a Judgment and decree against

the Defendant for:-

a) Permanent injunction restraining and restricting the

illegal activities of the defendant or her men and agents

or unlawful elements in any manner less fellows or any one

acting on their behalf from interfering or entering or disturbing

the Plaintiff peaceful possession and enjoyment of the

residence of the suit schedule hereunder in which the

Plaintiff residing in any manner initiating action against the

Plaintiff under the guise of collecting the money

b) Cost of the suit

c) Pass such further or other orders as this Hon’ble Court

may deem fit and proper to pass and thus render justice.
