THE CODE OF CONDUCT

PREAMBLE
The Na onal Bureau of Enforcement (NBE), Legal En ty of Public Law under the Ministry of Jus ce of Georgia, acknowledges that the conduct of its employees employees in the performance of their du es and as well as other job-related errands, is a precondi on to building trustworthy and fair image of and facilitate to the eec ve func oning the Na onal Bureau of Enforcement. The main purpose of the Na onal Bureau of Enforcement is to ensure eecve jus ce by means of upholding and protec ng the rights of the ci zens. Using the Cons tu on and the laws of Georgia together with the principles of the Rule of Law, honesty and impar ality; and in order to ensure that the jus ce is guaranteed, the Na onal Bureau of Enforcement has elaborated this Code of Conduct the purpose of which is to enhance independent ac on, impar ality and communitys trust among its employees.

AIM OF THE CODE The present document determines the rules and norms of professional ethics of the employees. The aim of the Code of Conduct is to determine specic rules of behaviour based on the moral principles imposed by the state and the society; and ensure that all employees maintain their professional merit, show respect and secure high quality performance of their du es. This Code of Conduct is a public document available to anyone interested and is aimed at increasing communitys awareness of the norms governing the behaviour of the public and private enforcement ocers.

DEFINITIONS Deni ons of the Code should not be limited. All provisions stated hereunder govern as well such aspects of the employees behaviour that are not stated in the Code but logically stem from its basic principles. Applica on of the Code is not limited to what is explicitly stated by the Code. The employees should behave in a way that is true to the spirit of the Code.

APPLICATION The Code equally governs the conduct of the employees of NBE: bailis, administra ve sta, personel directly or indirectly involved in enforcement process, within the set of rights and responsibili es imposed on them.

MORAL STANDARDS Every employee should regard that the specic nature of the work du es performed, imposes an ethical and moral responsibility towards the community. Employee should act in accordance with high standards of honesty and re-

sponsibility. Employees should perform their work du es with respect to the fundamental principles of culture, cordiality, dignity, mutual respect, trust, impar ality and equity. Employees should facilitate to the strengthening of the communitys trust and faith towards their profession. Employees are en tled to refuse to fulll any duty imposed by the immediate supervisor in case the la er contradicts with what is provisioned by the law.

PROTECTION OF HUMAN RIGHTS Employees should respect and protect human rights and freedoms s pulated by the Cons tu on and legisla on of Georgia as well as by the Interna onal Agreements; Respect of the principle of the dignity of a human being should be prac ced by all employees. Employees should take a stand against any sign of discrimina on.

PUBLIC RELATIONS When interac ng with the members of community employees of NBE should show respect towards their interlocutors, tac ully express their opinions and resort to well-grounded cri cs. Employees are obliged to respect opinions of others, and their freedom of expression unless it is abusing the rights and freedoms of the third persons. Employees are prohibited to express opinions that might be oensive or aim at disgracing the rights and freedoms of other persons based on the race, skin color, language, gender, religion, and poli cal, social status related, or economic and tular posi ons. In case conicts erupt during the interac on with the ci zens, employees are obliged to stay calm and prevent escala on of the conict. Whilst performing their work du es, employees should ensure that that the ci zens under enforcement understand the terminology used in rela on to the enforcement proceedings.

Employees are prohibited to distract ci zens from appealing against any breach or inadequate ac on of our personnel; Employees should not in any way discourage ci zens from appealing or complaining when they feel that their rights have been violated. Employees are prohibited to raise their voice and use inappropriate language while interac ng with the ci zens. Employees are prohibited to receive any kind of nancial incitement from the ci zens.

APPLICATION OF JOB STATUS Employees are allowed to use their job status only for the limited aims determined by the legisla on. It is prohibited: a) to abuse job status in order to suppress/discriminate others; b) to abuse work hours and the authoritys property for non-work related purposes; Employees are prohibited to use authoritys ID card outside their line of work. Employees are prohibited to hand their ID cards to others.

EFFICIENCY AND PROFESSIONALISM Employees are obliged to perform their work du es imposed by the legislaon with high standard of professionalism and responsibility. In the performance of work du es employees should stay impar al. Employees should behave in a way that promotes respect for jus ce among all par es.

INTERACTION WITH COLLEAGUES Employees a tude towards each other should support each others work du es. Employees should: a) Facilitate to the establishment of mutual trust among all colleagues and avoid erup on or escala on of any kind of private or work-related conicts; b) Share experience with other colleagues when needed; c) Restrain from unnecessary involvement into other colleagues ma ers; d) Restrain from any assistance when it has a nega ve impact upon performance of their own work du es; e) Never knowingly mislead their colleagues; f) Be tac ul when poin ng out someone elses mistakes or faults; g) Consider known principles and norms needed for the establishment of professional solidarity and healthy work environment; h) Never raise their voice or use inappropriate language while interac ng with their colleagues.

CONFIDENTIALITY Informa on that an employee got aware of in the performance of his/her work du es is conden al and should by no means be disseminated. It is prohibited to a end to other colleagues with ques ons rela ng to the conden al informa on, unless it is needed for work.

INADEQUATE STATE Employees should not be under the inuence of alcohol or any other powerful substance, or in a state that hinders performance of their respec ve work du es. Consump on of alcoholic drinks at the premises of the Na onal Bureau of Enforcement and its territorial bureaus is permissible only during ocial events and recep ons. Employees should use formal dress code. Casual and inappropriate ou its are prohibited during working hours.

CONFLICT OF INTERESTS Employees should refrain from any kind of ac vity that could put his imparality under ques on or inuence the performance of their work du es.
