Committee Report Nr. CR 0279-11 Letter dated 14 April 2011 of Mr. Rafael P. Delos Santos, Vice President, Asset Management and Disposition Group, Home Guaranty Corporation to Hon. City Mayor Mauricio G. Domogan, forwarding for confirmation the draft revised Deed of Donation regarding the turn over of the road lots and open spaces of Pinesville Subdivision. The Committee on Laws recommends discussion en banc of the above stated matter considering that what was enclosed in the letter of Mr. Rafael P. Cayat, OIC-City Planning and Development Coordinator, forwarding for information and appropriate action her findings regarding the letter dated 09 August 2010 of Hon. Oscar M. Camantiles, Municipal Mayor, Itogon, Benguet to Hon. City Mayor Mauricio G. Domogan, seeking among others intervention of the City of Baguio on the blatant disregard and outright defiance by the St. Bernice Homes Housing Subdivision Project under the LGTM Corporation of the Order dated 23 March 2010 issued by Dir. Paquito T. Moreno, Regional Director of EMB-CAR, ordering LGTM Corporation to pay the amount of P85,000.00 for violating ECC conditions and advising them to cease and desist from further construction activities except for the immediate implementation of the necessary mitigating measures along affected areas in the project site. 6. Committee Report Nr. CR 00329-11 Letter dated 23 December 2010 of Mr. Gerardo P. Verzosa, General Manager, BENECO, asking the inclusion of their newly acquired vehicles in the list of vehicles exempted from the Number Coding Ordinance.
(NOTE: Resolution Numbered 283, series of 2009 approved the amended recommendation of the Sangguniang Panlungsod Committee on Laws contained in its 3rd Indorsement dated 19 June 2009, on the request of the BENECO for exemption of its vehicles from the Number Coding Ordinance, subject to conditions.)

The Committee on Public Utilities, Transportation and Traffic Legislation recommends approval of the letter request of BENECO subject to the conditions as recommended by the Committee on Laws in its 2nd Indorsement dated 12 January 2011:
[a. Vehicles are subject to existing traffic laws and regulations; b. Exemption shall only be allowed when performing emergency repairs as provided for by Sec. 6 paragraph g of Ordinance Numbered 1, series of 2003, entitled The Baguio City Number Coding Scheme; c. Vehicles exempted shall always have a copy of a duly signed exemption for ready reference and availability when asked for by persons in authority; and d. That BENECO shall submit a list of its vehicles which are no longer serviceable or no longer in its possession, in order to be deleted from the list of BENECOs exempted vehicles which were previously approved.]

CR 00333-11 Proposed Resolution Nr. PR 0175-10 of Hon. Joel A. Alangsab and Hon. Nicasio M. Aliping Jr. Expressing full support and favorably endorsing the continued management and maintenance by the Benguet Electric Cooperative (BENECO) of the streetlights in the City of Baguio as supported by the barangay officials in the City of Baguio. The Committee on Public Utilities, Transportation and Traffic Legislation recommends APPROVAL of the proposed resolution. Hon. Fred L. Bagbagen, Member of the Committee, signified for discussion, refer to opinion of Mayor Domogan to further study said proposal as stated in Sunstar Baguio dated 10/22/10. Ernesto, Chairman, City Agricultural and Fishery Council (CAFC) submitting for consideration and appropriate action the CAFC Resolution No. 0012011 entitled, Resolution requesting the City Council of Baguio to cause the institutionalization of the City Agricultural and Fishery Council (CAFC) as partner of the city local government in matters concerning agriculture and fishery activities, and providing supplementary funds for its operations. The Committee on Ethics, Governmental Affairs and Personnel recommends that the letter of Ms. Balbina A. Committee Report Nr. CR 00356-11 a. Barangay Resolution No. 27, series of 2010, of East Bayan Park Barangay entitled, A resolution requesting the Honorable City Council to recall Ordinance No. 51, series of 2010 realigning the amount of P85,000.00
(NOTE: [a] Ordinance Numbered 51, series of 2010 realigned the amount of P85,000.00 appropriated under Item No. 65 (Barangay Development Programs) of the 2006 Annual Investment Plan (AIP) for the project Development of Water System to construction of a seventy-five (75)-meter drainage canal between Purok I and Purok 2 at East Bayan Park Barangay, Baguio City. [b] Ordinance Numbered 52, series of 2010 realigned the amount of P85,000.00 appropriated under Item No. 65 (Barangay Development Programs) of the 2006 Annual Investment Plan (AIP) for the project Development of Water System to purchase of urgently needed equipment for the clean and green project at East Bayan Park Barangay, Baguio City.)
b. Barangay Resolution No. 32, series of 2010, of Santo Tomas Proper Barangay entitled, Resolution requesting the Honorable City Councilor Nicasio S. Palaganas to re-align the city funded playground device in the amount of Fifty Thousand (P50,000.00) Pesos for the improvement of day care center. c. Barangay Resolution No. 22-11, series of 2011 of Hillside Barangay entitled, A Barangay Council Resolution requesting the Office of Hon. Councilor Nicasio S. Palaganas to allocate the necessary funding for the construction of a drainage canal system located between Bacwaden and Aquino residence at Purok 1, Hillside, Baguio City in the amount of Two Hundred Thousand Pesos (P200,000.00).

CR 00359-11 Memorandum of Agreement entered into by and between the City Government of Baguio represented by Hon. Mauricio G. Domogan, City Mayor and Blooming Hills Express represented by Mr. Mariano H. Tumayan Jr., on regulatory fees for the maintenance of peace and order, cleanliness and beautification as well as the enforcement of traffic rules and regulations at the loading/unloading area at Slaughterhouse Compound. The Committee on Laws recommends confirmation of the above stated Memorandum of Agreement and that it be notarized. (Item 19, 27 June 2011 Agenda) Committee Report Nr. CR 00362-11 1st Indorsement dared 18 May 2011 of Ms. Cordelia C. Lacsamana, City Government Department Head II, City Environment and Parks Management Office, interposing no objection to the proposal of Mr. John Kimo, President, Panagbenga Landscapers Association, for the adoption of a portion of the Picnic Grove at Burnham Park, specifically the area abutting the Baguio Water District Pumping Station and the Manang Police Station. Attached is a copy of the Adopt a Park Memorandum of Agreement entered into by
and between the Panagbenga Landscapers Association represented by Mr. John Kimo, President and the City Government of Baguio, represented by Hon. Mauricio G. Domogan, City Mayor, Baguio City.

With Resolution No. 16-89 and Resolution No. 069-1993 soliciting support from non-governmental organizations and other civic organizations for the improvement and maintenance of our city parks, the Committee on Tourism, Special Events, Parks and Playgrounds, with the favorable recommendation of CEPMO, recommends APPROVAL of the adoption of the subject park and that the Memorandum of Agreement for the said adoption be referred to the Committee on Laws for confirmation. The Committee on Laws recommends that the proposed amendatory ordinance as found in Item a, be APPROVED ON SECOND READING AFTER PUBLICATION, with the information that the amendment in the proposed ordinance as found in Item b, was consolidated with PO 015-08, as Section 2 e. Committee Report Nr. CR 0256-11 Letter dated 02 March 2011 of City Engr. Leo C. Bernardez Jr., asking possible consideration for the following questions in the amendment relative to Proposed Ordinance Nr. PO 005-11 and informing Administrative Order No. 021, series of 2011 issued on 17 February 2011 by the City Mayor: a. Where will the towed vehicles be parked? b. How much will be charged for towing fee for every kilometer and the storage fee for each day if the vehicle is recovered by the owner? c. Until when can a vehicle be stored and auctioned to defray the cost of storage? d. Are there penalties or charges besides the storage fees if the owners of towed vehicles fail to comply with the provision of the ordinance?
(NOTE: [a] The above matter is in reply to the letter dated 25 February 2011 of the City Secretary forwarding a copy of PO 005-11 to City Engr. Leo C. The Committee on Laws recommends to inform City Engr. Leo C. Bernardez Jr. that the answers to the questions raised relative to Proposed Ordinance Nr. PO 005-11 are contained in the Proposed Amendatory Ordinance Nr. PO 015-08 of Hon. Nicasio M. Aliping Jr. entitled, Amending Ordinance No. 07, series of 1984, Article XI [Stopping and Parking Vehicles] Section 7 [Use of City Streets and Roads as Parking Space for Junk Vehicles] and Ordinance No. 25, series of 2007, Article XVI [Penalties] Section 1, SubSection 11 [Leaving an unserviceable dilapidated or junk vehicle on any of the streets, roads or thoroughfare] known as the Comprehensive Traffic and Transportation Ordinance, as amended except for the question on storage fees. This shall form part of the committee report in the consolidation of the Proposed Ordinance Nr. PO 005-11 of Hon. Vice Mayor Daniel T. Farias and Proposed Ordinance Nr. PO 015-08 of Hon. Nicasio M. Committee Report Nr. CR 00392-11 a. Barangay Ordinance No. 02, series of 2011, of Santo Rosario Valley Barangay entitled, Ordinance mandating all the boarding house owners and operators to register the names of their tenants and boarders in the barangay roster. b. Barangay Ordinance No. 03, series of 2011, of Santo Rosario Valley Barangay entitled Ordinance mandating all barangay residents to have a unified barangay Identification Card (ID) of Santo Rosario Valley Barangay. For item a, the Committee on Laws recommends approval, but without penalties of the above stated barangay ordinance, considering that Section 394 of the Local Government Code, provides that: (d) The Barangay Secretary shall: (6) Keep an updated record of all inhabitants of the barangay containing the following items of information: name, address, place and date of birth, sex, civil status, citizenship, occupation, and such other items of information as may be prescribed by law or ordinance; (7) Submit a report on the actual number of barangay residents as often as may be required by the Sangguniang Barangay. For item b, the Committee on Laws recommends to return the barangay ordinance without City Council approval considering that Section 394 (d) of the Local Government Code also applies, and the residents should be allowed to use any valid identification card whenever transacting business with the barangay. Committee Report Nr. CR 00398-11 SECOND READING AFTER PUBLICATION BY POSTING: Proposed Ordinance Nr. PO 106-09 of Hon. Betty Lourdes F. Tabanda Establishing a trust fund to cater to the retirement benefits of the Integrated Barangay Tanods which shall be Two Thousand Pesos (P2,000.00) for every year of service, and appropriating the amount of P150,0000.00 as initial funds thereof.

Domogan, City Mayor, Baguio City, requesting support for the City of Baguio to be co-presenter/project partner for the launching of the event The Golden Years Festival in celebration of the month of the elderly on October 2011. This was forwarded to the Committee on Social Services, Women and Urban Poor on 21 June 2011.)

The Committee on Social Services, Women and Urban Poor, in its 4th Indorsement dated 22 June 2011 immediately forwarded the above mentioned letter of Prof. Federico A. Balanag to Ms. Betty F. Fangasan, City Social Welfare and Development Officer and Engr. Leopoldo S. Escao, OSCA Head, for their comments and recommendations, duly received by their offices on June 23, 2011. A copy of said indorsement was likewise forwarded to Prof. Balanag. To the present, the committee has not received any response from them on this matter. NEW MATTER: 49. FIRST READING: Referral to Committee Proposed Ordinance Nr. PO 0060-11 of Hon. Nicasio S. Palaganas Appropriating the amount of Eighty Eight Thousand One Hundred Thirty Six Pesos (P88,136.00) for the project rehabilitation of eroded alley near Aspiras residence at Siapno, Pacdal, Baguio City.
(NOTE: The above matter is related to the letter dated 13 April 2011 of City Engr. Leo C. Bernardez Jr., City Engineering Office, forwarding the cost estimate, plan and program of work of the project rehabilitation of eroded alley near Aspiras Residence at Siapno Pacdal, Baguio City to be funded from the savings of the project flood control at Regidor, Siapno Road beside Aspiras residence at Pacdal Barangay, Baguio City, amounting to P88,136.00. This was forwarded to the committee on Public Works on 19 April 2011.)
