Recording Summary Privacy Notice

Thank you for choosing "Recording Summary"! Recording Summary is an app (the "App")
developed and operated by OnePlus Technology (Shenzhen) Co., Ltd. ("we", "us", or
"our", registered at F18, Block C, Tairan Building, Tairan 8th Road, Chegongmiao,
Futian District, Shenzhen, Guangdong, China 518040) to provide users ("you", or
"your") with auxiliary tools for speech-to-text and text-based summary.
We attach great importance to the protection of your personal information and
privacy. We fully understand the importance of personal information to you. We have
developed this full version of the Recording Summary Privacy Notice (this "Privacy
Notice") in accordance with applicable laws, regulations, and state standards.
During your use of our accounts, websites, mobile apps, or other products and
services, we may collect, store, use, process, transmit, share, disclose, or delete
(collectively, "process") your personal information. In this Privacy Notice,
"personal information" or "personal data" refers to all information that can be
used alone or in combination with other information to identify a natural person.
This Privacy Notice explains how we process your personal information, the
categories of your personal information we process during your use of our services,
the purposes and methods of processing such information, your rights to such
information, the methods by which you can exercise such rights, and the security
measures we take to protect your personal information.
Before using the App, please carefully read this Privacy Notice, with special
attention to the terms highlighted in bold, to understand our practices regarding
the processing and protection of your personal information. If you do not agree to
the terms of this Privacy Notice, you can exit the App by tapping "Exit" and we
will not be able to provide you with the services related to Recording Summary. By
tapping "Agree and continue" to launch Recording Summary, you acknowledge that you
fully understand the collection and use of personal information and your rights
described below.
1. How We Collect and Use Your Personal Information
The information we collect depends on the features or services you use, the context
in which you interact with us, and the choices you make, including your privacy
settings and the features or services you use. Please note that if you provide
other people's personal information to us, you must ensure that you have obtained
their authorization (and separately obtain their consent in the event of a special
scenario). The features and services provided by the App may vary depending on the
countries or regions where our devices are sold, the operating system or app
versions running on the devices, and the apps installed or downloaded. Therefore,
the actual features and services provided by the App, personal information that
will be processed, and required app permissions are subject to the device you use.
You are not obliged to provide personal information to us. If you choose not to
provide the personal information necessary for the App to provide the required
services, we may not be able to provide you with such services, nor will we be able
to respond to or deal with any problems you may encounter. We collect personal
information for the purpose of operating more efficiently and providing you with
the best possible experience. The following describes in detail the categories of
personal information we collect as well as how and why we collect and use such
information.
Our channels for collecting personal data include:
directly from you;
automatically from your use of the App; and/or
from third parties.
If the following clauses explicitly state that relevant information about you is
only kept locally, then the information is collected and processed only on your
device and will not be uploaded to our servers, and such information is not bound
by this Privacy Notice. We aim here to provide clarification on any questions you
are likely to have and to be transparent about our processing of personal
information.
To provide you with the features or services you request or to comply with laws and
regulations, we will process the necessary information relating to you. This
Privacy Notice specifically points out what personal information is necessary for
you to use the features and services of the App. Please pay special attention to
such information.
1.1 How We Collect Personal Data and What Types of Personal Data We Collect
Personal Data You Provide to Us or We Automatically Collect
This app provides you with the ability to generate summaries. If Recording Summary
is available on your device and you have turned it on in "Settings - Additional
settings - Recording Summary - Recording Summary", you can turn on Recording
Summary in the Recorder app. After Recording Summary is turned on, we will use
Generative AI (GAI) technology to generate summaries of your recordings, so that
you can quickly learn about the content of the call when you are browsing call
logs. To this end, we will upload your recordings to transcribe them for you. The
aforementioned information will be deleted immediately after the processing is
completed, and it will not be stored on any server..
To use the Service, you may need to sign up for and sign in to an account according
to the laws of your country/region of residence. For more details on the protection
of personal information needed for account services, sign-up, and sign-in, please
refer to the Account Privacy Notice.
To allow you to view audio recordings, transcripts, and summaries, we will save
them to a private directory generated for the Notes app on your device.
The above information is necessary to use this feature. If you do not provide it,
you will be unable to use this feature.
Personal Data We Obtain from Third Parties
We may obtain personal data about you from third parties. For example, where
permitted by law, we may, based on the services and features of the App, obtain
data about you from public or commercial sources, including your activities on
social networks you use, and may combine it with other information received from
you or relevant to you. In particular, if you interact with us through a social
media site or third-party service, we may receive information from the social
network, including your profile information, picture, user ID associated with your
social media account, and any other information you permit the social network to
share with third parties.
2. How Long We Keep Your Personal Data
We will only store your personal data for as long as necessary to achieve the
collection purposes set out in this Privacy Notice, unless a longer retention
period is required by law. If we are required by law to store your personal data
beyond this period (such as for tax and commercial law reasons), we will delete the
personal data at the end of this storage period.
After the expiry of the aforementioned retention periods, we will delete or
anonymize your personal data.
To determine the appropriate retention period for personal data, we consider the
amount, nature and sensitivity of the personal data, the potential risk of harm
from unauthorized use and disclosure of your personal data, the purposes for which
we process the personal data and the applicable legal requirements.
Recordings and transcripts processed by Recording Summary will be deleted
immediately after the audio is transcribed, and the data will not be stored on any
server.
3. How We Disclose Your Personal Data
At times we may make certain personal data available to other companies that are
wholly or jointly controlled by us (the "Affiliates") and other third parties that
work with us in order to provide services to you. Your personal data will not be
shared with third parties for their own independent marketing purposes.
3.1. Our Cooperation with Third-Party Service Providers (Including SDK Providers)
Some of the features or services contained in the App are provided by third-party
service providers. We need to share the necessary personal information with such
third parties to provide you with the features or services that you request. We
will share your personal information only for legitimate, proper, necessary,
specific, and explicit purposes, and we will only share the personal information
necessary for the provision of the required services. Such third parties will have
no right to use your personal information shared by us for any other purpose. We
will sign a data protection agreement with each third party to clarify their
responsibility and obligation to protect your personal information.
3.2. Third-Party Service Providers and Their Services
Some of our features or services may contain links to third-party websites,
products, and services. You can choose whether to access or accept the websites,
products, and services offered by third parties. We have no control over third-
party privacy and personal information protection policies as such third parties
are not bound by this Privacy Notice.
After you are directed to such third-party websites, products, or services but
before you access specific functional modules or services, please carefully read
the privacy policies and related terms and conditions of the third-party website
operators or service providers.
4. How We Process Children's Personal Data
We greatly value our obligation and responsibility for protecting the personal
information of children. We strive to create a healthy cyber environment for them
and make extra efforts to protect them. We treat anyone under the age of 18 (or a
similar minimum age of full legal capacity defined in the jurisdiction concerned)
as a child. Most of the features and services provided by the App are intended for
adults, not for children. We do not provide services directly to children. Please
note that, due to technical limitations and other objective factors, the App may
not be able to actively identify your age.According to applicable laws and
regulations, if you are a child, you must obtain the consent of your parent or
another guardian before using the App, and be sure to carefully read this Privacy
Notice together with them. If you are the guardian of a child, before assisting the
child in using the App, you must carefully read both the Children's Privacy
Statement (if any) and this Privacy Notice. Please note that children are not
allowed to use the App without the consent of their parents or guardians.
We do not actively collect, store, use, transfer, or disclose children's personal
information, let alone use their personal information for marketing purposes. If
you are a child, or if you are a parent or guardian of a child, or if you otherwise
find that any information we processed may contain the personal information of a
child, please contact us as set forth in this Privacy Notice. We will do everything
we can to delete the relevant data as soon as possible.
5. How Your Personal Data Is Transferred Globally
As a company operating globally, we provide products and services through resources
and servers around the world. For the purpose of ensuring the high quality of our
services (such as ensuring a high processing speed) and subject to local data
protection laws, we will store your personal data based on the region or country
where your mobile phone is purchased or configured. We have established data
centers in France, Singapore, India, and Indonesia. This means that your personal
information may be transferred to or accessed from a jurisdiction outside the
country or region where you use our products or services..
Please note that different countries or regions offer different levels of data
protection. This means that your personal data could be stored in a country that
offers a level of protection that may, in certain instances, be less protective of
your personal data than the country or region in which you are located. You

the settings from time to time to improve your user experience. Therefore, the
operation paths described below are for your reference only. If you have any

You can turn Recording Summary on or off in "Settings - Additional settings -
Recording Summary - Recording Summary". By doing so, you will permit or disable the
processing of your personal information necessary to use this feature.
If you are domiciled in the European Union, Liechtenstein, Norway, the United
Kingdom or Switzerland ("Europe"), you can go to "Settings - Additional settings -
Recording Summary - Privacy - Withdraw consent to Privacy Notice" to disable the
processing of your relevant personal information. To learn more about your rights
to your personal information, refer to Privacy Notice.
7. How This Privacy Notice Is Updated
We reserve the right to update or modify this Privacy Notice from time to time. We
will notify you of any material changes to this Privacy Notice in a manner we deem
appropriate, and we will indicate the "Last updated" date at the top of this
Privacy Notice.
This Privacy Notice is subject to adjustments. If you continue to use the App after
this Privacy Notice is updated, you will be deemed to have accepted the new Privacy
Notice.

The terms below only apply to users domiciled in Europe.
9.1 Legal Bases for the Processing of Personal Data
Our processing of your personal data as described in the Section "How We Use Your

refuse or withdraw your consent at any time. The withdrawal of your consent does

refuse or withdraw your consent, we may not be able to provide you with the service
