Human Rights Alert's submission to the Human Right Council of the United Nations, as part of the 2012 Universal Periodic Review of Human Rights in Israel, is nearing its completion. [1] It is, I believe, unprecedented, in being primarily based on data mining, with no proconceived bias as to types of cases, judges, or criticisms of the courts from various sides. In fact, the submission hardly relies on any significant legal analysis or claims, except for matters related to Fair Hearings procedures , legal record-keeping, certification, service of judicial records, etc... Regardless, the draft Conclusions and Recommendations are serious in their implications:
Conclusions: - Precipitous deterioration in integrity of the electronic records of the courts of the State of Israel is documented over the past decade. - Prevailing conditions should be deemed a failure of the legal profession, which undermines the rule of law, civil society and socioeconomic development - a constitutional crisis in a nation with no constitution. - The findings should require re-assessment of other documentation, provided by the State of Israel, and employed in the UN HRC UPR process. - Nations, who are parties to the Hague Apostille Convention (1961), and others, should reassess faith and credit, which may be given to legal public records originating in the State of Israel. - The findings have far reaching implications in analysis of societal, economic, and regional/global violence. - Efforts to address the matter by the State of Israel, are likely to be compounded by numerous conflicts of interests, with group rivalries in the highest levels of government and the professions, according to fine religious, ethnic, and even security force backgrounds. Recommendations: - Resolution of the crisis would have to draw upon civil society agents within the legal profession, and also most likely computing experts and religious leaders, perhaps the Israel Academy of Sciences and Humanities.

- Thorough, public investigation of events surrounding the March 7, 2002 death of Supreme Court Chief Clerk Shmaryahu Cohen is warranted. - Truth and reconciliation commission may also be required to resolve the disposition of the large number of missing and falsified court records from the past decade, and to investigate, whether judges/justices and/or senior officers of the Ministry of Justice have been involved in wholesale violations of their oaths of office.

Additional specific statements may refer to the entire period from 2003 to this date, or parts of it (the Apostille certification arrangement is undated, for example): The unsigned, undated Apostille certification arrangement, which is published on the web site of the Judicial Authority, but relative to which the Administration of Courts denies access to any legal public record is deliberately misleading both in its intention to circumvent the refusal of Chief Clerk(s) to certify the records of the court(s), and by invoking the authority of an unnamed Minister of Justice with no foundation in a legal public record. Therefore, the published Apostille certification arrangement should be deemed a fraudulent, illegal public record of the State of Israel, in violation of various Human Rights and the Hague Apostille Convention (1961). [2,3,4,5] The conduct of Sarah Lifschitz, who signs correspondence, "Chief Clerk" of the Supreme Court, but refuses to certify judicial records, which were published online by the "Information Center", "operating in the Supreme Court", or administrative court records of the Supreme Court, which were published online by the "Judicial Authority", combined with the Freedom of Information Act (1988) response (P29-2012) by the Administration of Courts, which denied public access to any legal public records for either the Appointment of Sarah Lifschitz Chief Clerk of the Supreme Court, or certification procedures of the Supreme Court's records, amounts to large-scale public deception. Sarah Lifschitz' conduct, as an individual, and in appearing as the lawful Chief Clerk of the Supreme Court of the State of Israel should be deemed in violation of various Human Rights and the Hague Apostille Convention (1961).
