IT ACT AMMENDMENT OF

2008

Various Criminal Provisions were been introduced in the amendment of IT act of 2000
All the sections under 43 and 66 are covered under the IT act of 2008
These include: Section 66(A)
Section 66(B)
Section 66 (C)
Section 66(E)
Section 66(F)
Section 67
Section 67(A)
Section 67(B)
Section 67(C)

Section 66(A)
Sending of offensive or false messages
Also known as cyber stalking
Covers sending of false messages via Email/SMS/MMS
Punishment : imprisonment up to 3 years with fine.

Section 66(B)
Dishonestly receiving stolen computers and other
communication devices.
Use of stolen computers, mobile phones, sim cards
Punishment : Imprisonment up to 3 years and fine of Rs
1 Lakh

Section 66(C)
Identity Theft
Fraudulently or dishonestly using someone elses
electronic signature, password or any other unique
identification number.
Punishment : imprisonment up to 3 years with a fine of
Rs 1 Lakh

Section 66(E)
Violation of privacy
Popularly Known as Voyeurism
Covers act like placing cameras in Toilets, Changing
rooms, Hotel Rooms Etc.
Punishment : Imprisonment up to 3 years with a fine of
2 Lakhs

Section 66(F)
Cyber terrorism
Whoever uses cyber space with intent to threaten the
unity, integrity, security & sovereignty of India or to
strike terror in the people.
Punishment: Imprisonment which may extent to life
imprisonment.

Section 67 (A,B,C)
Publishing or transmitting obscene material in electronic
form.
Publishing or transmitting sexually explicit content in
electronic format
Creating, collecting, browsing and downloading of child
pornography.
Punishment: Imprisonment of 3 years and fine up to 5
Lakh. Subsequent imprisonment up to 5 years and fine
of Rs 10 Lakh
