Problem faced in common law court
• There were problems and defects regarding the common law court
system
• It had caused dissatisfaction among the people.
• The defects had led to injustice and the reason why justice failed to
prevail.
• There are several reasons as to why injustice had been so prevalent in
the common law court which are insufficient writs, inadequate
remedies, jury system and judicial precedent.
Insufficient writs
• Cases need to be filed via writs in the common law court.
• Formality is prioritised and therefore the appropriate type of writ
must be used to file each claim.
• The chancery was unable to develop the writs according to the
development of claims.
• A lot of people were unable to claim in the common law courts even
though they had valid claims.
• Writs were undeveloped because of political and economical
restraint.
Inadequate Remedies
• There was limited remedies, and it was inadequate because the
people were dissatisfied with the remedy that the common law court
had provided.
• The remedy that was available was damages/monetary
compensation.
• But, damages alone was insufficient to remedy all the claims.
