Warming Up
• Have you ever heard about enquiry ?
• How many types of enquiries are there ?
RELEVANCE
• SOs & GOs are required to conduct P.E.s at
several occasions for various administrative
reasons, which makes it more relevant for SO
& GO trainees to have the exposure and better
role clarity of P. E.O. for conduct of P. E.
judiciously .
LEARNING OBJECTIVE

• At the end of the session the participants will be


able to tell about:
– nature of PE

– planning to be done beforehand

– selection and security of document

– examination of witnesses and alleged official

– submission of report
NATURE
P.E. :--
• It is a fact finding enquiry
• It is informal in nature
• No prescribed format
• It may be held confidentially
- - alleged official examined at regular enquiry
• Signature of witnesses shall be obtained
• PE need not be referred in regular enquiry .
PLANNING AND HOW TO PROCEED

• To understand first to what exactly is his job.

• E.O. should chalk out following:


– what documents and where are they?

– who are the witnesses

– to examine suspect or not, if so in first or at the end


SELECTION AND SECURITY OF DOCUMENTS

 Documents are very important :

• Secure the document first

• Likely to be tampered should be seized

• Will help in planning future steps

PREPARATION w. r. t. WITNESSES

• Whom to examine first

• Questions to be asked to each witness

• To be examined on relevant points


EXAMINATION- WITNESSES/ALLEGED OFFICIAL
• Be courteous

• Avoid making comments-humiliation

• Listen to witness & record what he says

• Ask questions at the end to clarify doubts

• Prejudiced witnesses should be carefully examined

• If PE is confidential suspect not to be examined

• No attempt to obtain admission of default


PRECAUTIONS - WRITING/SUBMISSION OF REPORT

After examining - prepare report bearing following


points in mind:-
• Should not be emotional
Favouring/ disfavouring will have adverse consequences
• Be brief- specific- mention allegation - source of
verification & documents examined
• Mention circumstances leads to misconduct and pin
point responsibility
• No opportunity of cross examination
• Conclude report ‘ prima facie’ case exists/ does not
exist .
PROCESS
(A common lay out of a P.E.)

• Introduce yourself, mentioning order & subjects


• Give gist of complaint
• Mention documents/witnesses
• Mention gist of statements/documents
• Findings with reference to statements
(Brief of the Case - Analysis - Conclusion)
• Establish responsibility ‘prima facie’
• Enclose all documents in original & forward
