LEGITIMATION

Legitimate power is the right to exercise control


over others by virtue of the authority of one's
superior organization position or status.
Legitimation of power can be understood using Max
Weber's traditional bases of power. In
a bureaucracy, people gain legitimate use of power
by their positions in which it is widely agreed that
the specified person hold authority. There is no
inherent right to wield power.
POLICY LEGITIMATION

• Giving legal force to decisions, or authorizing


or justifying policy action
• Comes from majority vote in legislature and a
formal executive, bureaucratic, or judicial
decisions
• Requires more than majority vote or sanction
by legal authority.
LEGITIMIZATION

For example:
A president can exercise power and authority
because the position is fully legitimated by
society as a whole.

•The DOH initially proposed that 122 medicines be included in


the second phase of the imposition of the Maximum Drug Retail
Price (MDRP). The last MDRP was imposed in 2009 and only
included five medicines
•Ceiling prices for the 87 medicines with 133 formulations at the
point of wholesale and retail shall be imposed in both public and
private drug retail outlets including chain and independent
drugstores, hospital pharmacies, health maintenance
organizations and other outlets within 90 days, said Duque.

administrative order to ensure the effective
implementation of the EO, and will disseminate

APPOINTMENT OF CABINET
SECRETARY
• According to the Article 7, Section 16, the President may
appoint anyone to executive departments with the
consent of the Commission on Appointments. Names of
individuals nominated to cabinet posts are submitted to
the Commission on Appointments for their consideration.
• An individual may not assume his post in a given
department unless confirmed by the Commission on
Appointments. However, the constitution provides for
individuals becoming cabinet secretaries in an acting
capacity before they are confirmed.
APPOINTMENT OF CABINET
SECRETARY
• According to Article VII, Section 16 of the
constitution, the president may appoint anyone
to cabinet posts even if Congress is in recess.
These appointments are valid until the
Commission on Appointments disapproves them,
or at the end of the next session of Congress.
• Not all cabinet members, however, are subject to
confirmation of the Commission on
Appointments.
