Compulsory Acquisition of Land

 Whenever Govt. require a particular land for any specific public


purpose, it can acquire such land and pay compensation to the owner
of land and other interested persons whose interests have been
proved.

 The owner’s right, title and interest in the land is permanently


extinguished including the easement attached to the acquired land

 Compensation at the prevailing market rate and Solatium is paid to


the land owner

 SOLATIUM – In addition to market value, Owner is entitled to


additional compensation of 15% on the value of land due to
compulsory acquisition
Requisition of Land

 At times Govt. merely wants to requisite a property which may


be necessary to deal with an emergency or natural calamities

 Govt. takes possession of that property which may be just a portion


of land or a property consisting of land & buildings.

 Intention – only of temporary occupation and use

 Property is intended to be handed over to the owner as soon as the


emergency / need for temporary occupation is over.

 Rent or Compensation of the period for which the property is used is


paid to the Owner.
