Introduction
An Act to provide for the termination of certain pregnancies by registered
medical practitioners and for matters connected therewith or incidental thereto
The act extends to the whole of India except the State of Jammu and Kashmir
Definition
"guardian" means a person having the care of the person of a minor or a lunatic;
“lunatic“ (now its Mentally ill person) has the meaning assigned to it in Sec.3 of
the Indian Lunacy Act, 1912
"minor" means a person who, under the provisions of the Indian Majority Act,
1875 (9 of 1875), is to be deemed not to have attained his majority,
Amended act
"termination of pregnancy" means a procedure to terminate a pregnancy by
using medical or surgical methods.'
Who can terminate?
A pregnancy may be terminated by a registered medical practitioner,-
(a) where the length of the pregnancy does not exceed (twelve weeks) twenty
weeks if such medical practitioner is, or
(b) where the length of the pregnancy exceeds (twelve weeks) twenty weeks but
does not exceed (twenty weeks) twenty four weeks, if not less than two
registered medical practitioners are present.
Indications for Termination
(1) the continuance of the pregnancy would involve a risk to the life of the pregnant woman or of grave injury
physical or mental health ; or
(2) there is a substantial risk that if the child were born, it would suffer from such physical or mental
abnormalities as to be seriously handicapped
Explanation 1.-Where any, pregnancy is alleged by the pregnant woman to have been caused by rape, the
anguish caused by such pregnancy shall be presumed to constitute a grave injury to the mental health of the
pregnant woman.
Explanation 2.-Where any pregnancy occurs as a result of failure of any device or method used by any
married woman or her husband for the purpose of limiting the number of children, the anguish
caused by such unwanted pregnancy may be presumed to constitute a grave injury to the mental
health of the pregnant woman.

(3) In determining whether the continuance of pregnancy would involve such
risk of injury to the health as is mentioned in sub-section (2), account may be
taken of the pregnant woman's actual or reasonable foreseeable environment.
(4) No pregnancy of a woman, who has not attained the age of eighteen years,
or, who, having attained the age of eighteen years, is a lunatic, shall be
terminated except with the consent in writing of her guardian
Place to Terminate
(a) a hospital established or maintained by Government, or
(b) a place for the time being approved for the purpose of this Act by
Government.
Punishment
Any person doing MTP and not a RMP , RMP can be punished for 2-7 years of
rigourous imprisonment
If terminated in a place where its not approved then they will be punished for 2-7
years of rigourous imprisonment
Owner of unapproved place performing termination can also be punished with
rigourous imprisonment 2-7 years.
Amended Act,2021
Twenty weeks of gestational age extended to Twenty Four weeks
Protection of privacy of a women
No registered medical practitioner shall reveal the name and other particulars of a
woman whose pregnancy has been terminated under this Act except to a person
authorised by any law for the time being in force.
Punishment
Whoever contravenes the provisions of sub-section (1) shall be punishable with
imprisonment which may extend to one year, or with fine, or with both.".
Summary
Its for legal termination of pregnancy
Its now upto 24 weeks of GA
Its performed by one RMP if its within 20 weeks and two RMP’s if more than 20
weeks
Its performed at a registered medical facility.
Punishment: 2-7 years imprisonment
