Absolute Pardon
It refers to the total extinction of the criminal liability
of the individual to whom it is granted without any
condition whatsoever and restore to the individual his
civil rights and remit the penalty imposed for the
particular offense of which he was convicted.
(Types of Pardons )
Full. Unconditionally absolves the person of the
conviction and all of the crime's consequences.
Partial. Only relieves the person from some of the
crime's punishment or consequences.
Absolute. Granted without any conditions.
Conditional.
Purpose:

To right a wrong


To normalize a tumultuous political situation.
WHAT IS THE PURPOSE OF
ABSOLUTE PARDON?

Absolute pardon is a pardon which releases the wrongdoer


from punishment and restores the offender's civil rights
without qualification. Absolute pardon is also known as a full
pardon and unconditional pardon.

Governor is convinced that the petitioner is
innocent of the charge for which he or she was
convicted. An absolute pardon is often a remedy
of last resort. In order to be eligible for an
absolute pardon, you must have:
1.Pled not guilty throughout the judicial process.
2.Exhausted all forms of judicial appeals and
other remedies, including a Writ of Actual
Innocence.
In 2016, Duterte pardoned Robin Padilla, who was
convicted of illegal possession of firearms in 1994. This
particular pardon fully restored the actor's civil and
political rights, as the one granted by then-president
Fidel Ramos in 1998 did not.
• Even a former president, Joseph Estrada who was
convicted of plunder, was pardoned by then-president
Gloria Macapagal Arroyo in 2007.
Who qualifies for pardon?

Convicts already served "maximum sentence or


granted final release discharge or court termination of
probation" may apply for absolute pardon
How does an application process start?
A petition for pardon should be addressed to the
Philippine president and corsed through the Board of
Pardons and Parole ( BPP ) • It should be supported by
document such as the certificate of finality of
judgement and document of service of sentence
among others
To be qualified for an Absolute
Pardon one must:
have already served one’s maximum sentence, been granted
final release and discharge, or given court termination of
probation; or,
be 65 years old and above, and have served at least five years
of one’s sentence or whose continued imprisonment is
“inimical to their health,” as recommended by health
authorities.
Summary
In our report it also talks about absolute pardon in which the absolute
pardon is form of executive clemency that granted by the Philippine
president to the convicted offenders and also the purpose of absolute
pardon on how to help those qualified for absolute pardon. Not only
the President be granted for absolute pardon but also the Governor
had a right be granted for absolute pardon if he/she is convinced that
the petitioner is innocent of the charge for which he or she was
convicted. There are types of pardons first is Full, Partial and Absolute.
In Absolute Pardon the punishment will restores the offender's civil
rights without qualification and order to restore the full political and
civil rights to convicted persons who have already served their
sentenced.

 
What is the effect of Absolute Pardon?

As expressed by the dual nature of a crime, absolute


pardon does not relieve the offender from his civil
liability. Though absolute pardon is a cause for total
extinction of criminal liability, yet there are
consequences of conviction left inspite of the grant of
such clemency.
