In the Civil Servants Act, 1973 (LXXI of 1973), in


section 3, after sub-section (3) new sub-sections has
been added:-
THE CIVIL SERVANTS (AMENDMENT)
BILL, 2013

Section 3, Sub-Section (4):-


“The Federal Government may transfer a Civil Servant
working in an attached Department or Subordinate
Office of the devolved Ministries, situated in a province,
to the province concerned in consequence of the
devolution of functions under the provisions of the
Constitution (18th Amendment) Act, 2010 (X of 2010)
and hereby he shall become the Civil Servant of the
respective province on the same terms and conditions of
service as were applicable to him before such transfer”

Section 3, Sub-Section (5):-


“The Federal Government may transfer a Civil Servant,
working in Islamabad in a Ministry, Division, Attached
Department or Subordinate Office, to other Ministry,
Division, Attached Department or Subordinate Office in
Consequence of the abolition of Ministries under the
provisions of the Constitution (18th Amendment) Act, 2010
(X of 2010) and thereby he shall become the Civil Servant of
the respective Ministry, Division, Department or Office to
which he is so transferred, on the same terms and conditions
of service as were applicable to him before such transfer”

PROPERTY BOARD WHICH NEEDS TO BE
ADDRESSED ON IMMEDIATE BASIS.

THE PROVINCIAL ASSEMBLY OF SINDH, IN ITS


RESOLUTION ON 10TH FEBRUARY, 2010 HAS ALSO
DEMANDED THE TRANSFER OF EVACUEE TRUST
PROPERTY TO SINDH.

THE PRESIDENT OF PAKISTAN HAS ALSO BEEN


PLEASED TO GRANT THE REQUEST OF THE HINDU
COMMUNITY FOR THE TRANSFER OF EVACUEE
TRUST PROPERTY TO SINDH.
4. ON ABOLITION OF FEDERAL CONCURRENT LEGISLATIVE
LIST UNDER THE 18TH CONSTITUTIONAL AMENDMENT,
FOLLOWING SUBJECTS OF THE FOURTH SCHEDULE OF
THE LIST STOOD TRANSFERRED TO THE HEALTH
DEPARTMENT, GOVERNMENT OF SINDH:-

i) DRUGS AND MEDICINES;


ii) POISONOUS AND DANGEROUS DRUG;
iii) PREVENTION OF THE EXTENSION FROM ONE PROVINCE TO ANOTHER.
INFECTIIOUS OR CONTAGIOUS DISEASES OR PESTS AFFECTING MEN,
ANIMAL OR PLANTS;
iv) POPULATION PLANNING AND SOCIAL WELFARE (PARTY)
v) CURRICULUM, SYLLABUS, PLANNING, POLICY, CENTERS OF EXCELLENCE
AND STANDS OF EDUCATION (PERTAINING TO MEDICAL EDUCATION);
vi) LEGAL, MEDICAL AND OTHER PROFESSIONS.
THE FOLLOWING INSTITUTIONS AND SUBJECTS STANDS
DEVOLVED TO THE HEALTH DEPARTMENT, GOVERNMENT
OF SINDH.

i) MEDICAL, NURSING DENTAL, PHARMACEUTICAL,


PARAMEDICAL AND ALLIED SUBJECTS (EXPECT TO THE
EXTENT OF FEDERAL AREAS);
ii) PREVENTION OF THE EXTENSION FROM ONE PROVINCE TO
ANOTHER INFECTIOUS AND CONTAGIOUS DISEASES;
iii) LUNACY AND MENTAL DEFICIENCY;
iv) JINNAH POSTGRADUATE MEDICAL CENTER (JPMC), KARACHI;
v) NATIONAL INSTITUTE OF CHILD HEALTH (NICH), KARACHI;
vi) NATIONAL INSTITUTE OF CARDIOVASCULAR DISEASE (NICVD),
KARACHI;
vii) VERTICAL PROJECTS.
Since the devolution was made under the constitutional
amendment, it was constitutional requirement that the
devolution should have been made in its totality and entirety.
Assigning of majority of the subjects to the federal
ministries/divisions instead of the provinces is against the
spirit of the constitution of Islamic Republic of Pakistan.
