IT IS THE TAKING, WITH INTENT TO GAIN, OF A
MOTOR VEHICLE BELONGING TO ANOTHER WITHOUT THE LATTER’S CONSENT, OR BY MEANS OF VIOLENCE AGAINST OR INTIMIDATION OF PERSONS, OR BY USING FORCE UPON THINGS DEFINITION OF TERMS ELEMENTS OF CARNAPPING
1.) That there is an actual taking of the vehicle
2.) That the offender intends to gain from the taking of the vehicle 3.) That the vehicle belongs to another person, other than the offender himself 4.) That the taking was without the consent of the owner thereof; or that the taking was committed by means of violence against or intimidation of persons, or by using force upon things WHAT IS UNLAWFUL TAKING AND WHEN IS IT DEEMED COMPLETE?
"Gain" doesn't necessarily mean profit; even if the taking
was for a joyride it's still considered carnapping No. Although carnapping and robbery have the same element of taking with intent to gain, the former specifically refers to the unlwaful taking of a motor vehicle only. (Sec 5) THE DUTY OF THE COLLECTOR OF CUSTOMS UPON ARRIVAL OF IMPORTED VEHICLE VIOLATION OF OTHER PROVISIONS:
2 to 6 years and a fine equal to
the purchase price of the stolen vehicle, engine or part involved in the violation. WHAT IS THE PENALTY IF COMMITTED BY AN ALIEN? Aliens convicted under the provisions of this Act shall be deported immediately after service of sentence without further proceedings by the Deportation Board. Yes. Anyone who volunteers information leading
to the recovery of carnapped vehicles and the conviction of the perpetrators shall be given a cash reward which is to be fixed by the NBI. The information will be treated as confidential matter.
