FR/SR Part-III Leave Rules

– General Principles
> Grant of leaves is governed under Central Civil Services (Leave) Rules, 1972.

> Leave is a not matter of right - Rule 7(1)

> The leave sanctioning authority may refuse or revoke leave of any kind; but cannot

alter the kind of leave due and applied for by the employee - Rule 7(2)
> No leave can be granted for a continuous period of 5 years.

> An official remaining absent for a continuous period of 5 years without valid reason

shall be deemed to have resigned from service. – Rule 12.

> During leave, no service or employment can be taken up by an employee. – Rule 13.
> Leave on medical ground shall be supported by CGHS doctor or AMA (All Govt.

doctors are AMA) as applicable. – Rule 19

> The leave sanctioning authority may, at its discretion, seek second medical opinion

from Medical Board.

> An official on leave on medical ground shall be allowed to join duty only with

submission of a medical fitness certificate. – Rule 24(3)


> An absence, unless regularized by grant of leave, not in continuation of authorized

leave will constitute break in service. – Rule 25(1)

> Authority competent to grant leave may commute retrospectively periods of

absence without leave, into extra-ordinary leave. – Rule 32(6).
