Facts of the case:
ON APRIL 20, 2020 IN TACLOBAN CITY, THE ACCUSED RALPH ANTIVO WITH
DELIBERATE INTENT TO KILL AND WITH TREACHERY, ARMED WITH FIRE ARM M4A1
RIFLE, SHOT JOJIMAR LAODENO MULTIPLE TIMES ON THE UPPER PART OF HIS BODY
INFLICTING UPON GUNSHOT WOUNDS WHICH CAUSED HIS INSTANTTANEOUS DEATH
AND AS CONSEQUENCES OF WHICH ALSO CAUSED TRAUMA TO THE VICTIMS FAMILY.

THE SAID VICTIM AND SUSPECT WERE NEIGHBOURS AT PHASE 3, LIME ST. BRGY
109. TACLOBAN CITY, LEYTE. JOJIMAR AND RALPH WERE FRIENDS GROWING UP, SADLY
THERE FRIENDSHIP COLLAPES BECAUSE OF THE LAND WHICH THEY CALIM TO BE
THEIRS.
THURSDAY AFTERNOON, WHILE THE VICTIME, JOJIMAR LAODENO WAS ON HIS
DUTY AT HIS OWN HOUSE ON ABOUT 3 O’CLOCK WHILE DOING HIS WORK WHEN
SUDDENLY RALPH ANTIVO, THE SAID SUSPECT CONFRONTED JOJIMAR LAODENO ABOUT
THE LAND THE THEY CLAIM TO BE THEIRS. JOJIMAR LAODENO DOESN’T WANT ANY
TROUBLE, BUT THE ARGUMENT BETWEEN THE SUSPECT AND VICTIME GOT HEATED UP
INSTANTLY. RALPH ANTIVO PROVOKED JOJIMAR LAODENO WITH HIS WORD “ANO
PUNITI NALA KITA? YAWA KA NA BAYOT KA, DIRE KA MAN NGAY-AN MA-ATO.” BUT
JOJIMAR LAODENO’S WIFE, JANIKA LAODENO KEEP HIS HUSBAND AWAY FROM
TROUBLE. RALPH ANTIVO LEFT BUT GOT RIGHT BACK IMMEDIATELY WITH HIS M4A1
RIFLE AND SHOT THE VICTIME MULTIPLE TIMES IN HIS UPPER BODY WHICH CAUSED
FOR THE VICTIM TO FALL DOWN, AFTER THE SHOOTING INCIDENT, THE SUSPECT
IMMEDIATELY GO TO HIS CAR AND DROVE IT TO HIS GARAGE WHICH IS ONLY FEW
BLOCKS AWAY FROM THE CRIME SCENE.
JOJIMAR LAODENO WAS IMMEDIATELY TAKEN INTO A HOSPITAL BUT DECLARED DEAD
ON ARRIVAL. THE CADAVER OF THE VICTIM WAS MOVED TO REGIONAL CRIME OFFICE,
CAMP LOUEI ESMA, TACLOBAN CITY FOR AUTOPSY EXAMINATION. THE IMMEDIATE
CAUSE OF HIS DEATH WAS GUNSHOT WOUND ON THE HEAD AND CHEST.

THE SUSPECT, RALPH ANTVO WAS ARRESTED AT HIS HOUSE DURING HOT PURSUIT
OPERATION LEADING BY SPO3 MARVEN BALUNAN AND SPO2 MARVIN DISTRAJO. THE
AUTOMATIC RIFLE WAS RECOVERED AND THE SUSPECT IS UNDER CUSTODY FOR
FURTHER INVESTIGATION AND PROPER DISPOSITION
THE ACT COMMITTED BY THE SUSPECT:
REPUBLIC ACT 7695. SECTION 6 OF ARTICLE 248
REPUBLIC ACT NO. 7659
AN ACT TO IMPOSE THE DEATH PENALTY ON CERTAIN HEINOUS CRIMES, AMENDING FOR THAT PURPOSE
THE REVISED PENAL LAWS, AS AMENDED, OTHER SPECIAL PENAL LAWS, AND FOR OTHER PURPOSES
WHEREAS, the Constitution, specifically Article III, Section 19 paragraph (1) thereof, states “Excessive fines shall not be imposed
nor cruel, degrading or inhuman punishment inflicted. Neither shall death penalty be imposed, unless, for compelling reasons
involving heinous crimes, the Congress hereafter provides for it. . .”;
WHEREAS, the crimes punishable by death under this Act are heinous for being grievous, odious and hateful offenses and which, by
reason of their inherent or manifest wickedness, viciousness, atrocity and perversity are repugnant and outrageous to the common
standards and norms of decency and morality in a just, civilized and ordered society;
WHEREAS, due to the alarming upsurge of such crimes which has resulted not only in the loss of human lives and wanton
destruction of property but also affected the nation’s efforts towards sustainable economic development and prosperity while at the
same time has undermined the people’s faith in the Government and the latter’s ability to maintain peace and order in the country;
WHEREAS, the Congress, in the justice, public order and the rule of law, and the need to rationalize and harmonize the penal
sanctions for heinous crimes, finds compelling reasons to impose the death penalty for said crimes;
Section 6. Article 248 of the same Code is hereby amended to read as follows:
“Art. 248. Murder. – Any person who, not falling within the provisions of Article 246 shall kill another,
shall be guilty of murder and shall be punished by reclusion perpetua, to death if committed with any of
the following attendant circumstances:
1. With treachery, taking advantage of superior strength, with the aid of armed men, or employing means
to weaken the defense or of means or persons to insure or afford impunity.
2. In consideration of a price, reward or promise.
3. By means of inundation, fire, poison, explosion, shipwreck, stranding of a vessel, derailment or assault
upon a railroad, fall of an airship, or by means of motor vehicles, or with the use of any other means
involving great waste and ruin.
4. On occasion of any of the calamities enumerated in the preceding paragraph, or of an earthquake,
eruption of a volcano, destructive cyclone, epidemic or other public calamity.
5. With evident premeditation.
6. With cruelty, by deliberately and inhumanly augmenting the suffering of the victim, or outraging or
scoffing at his person or corpse.”
