FOR ALLOCATING SEATS
UNDER THE PROPORTIONAL
SYSTEM OF
REPRESENTATION IN THE
BARMM
• ALLOCATION OF SEATS OF THE
PROPORTIONAL REPRESENTATION. A clear
policy on the determination of seats in case of
fractional results should be provided. The formula
to be adopted should be in the code to lessen the
bulk of election disputes and protests.
– Threshold: 2.5% of the total number of votes cast for PR (Minimum)
– BANAT ( BARANGAY ASSOCIATION FOR NATIONAL
ADVANCEMENT AND TRANSPARENCY) vs. COMELEC
– Winner Takes All (only parties who have met the threshold will be
eligible for a seat in the parliament)
• POLICY ON ELECTION FOR
SECTORAL AND RESERVED SEATS.
Given that there is no national law
providing for the manner or election of
sectoral representatives, the Parliament
should take into consideration practice of
consensus building in Islam and the
Indigenous People.
• POLICY ON ALLOCATION OF DISTRICT SEATS. The Bangsamoro
Organic Law empowered the parliament to determine the parliamentary
districts of BARMM. Anent this, BTA members should take into
consideration the jurisdictional boundaries of existing congressional
districts. To have voters of one parliamentary district to vote for different
congressional districts would be chaotic. They have to consider the fact
that they will also vote for local and national positions.
• NORTH COTABATO. The 63 Barangays of North Cotabato will be
voting for the first time under the autonomous region. They still have
their respective municipal and provincial governments that belong to a
different region. The parliament should be able to determine the number
of district seats for the representation of these Barangays and ensure the
inclusion of a nominee in the proportional representation system
representing the 63 Barangays.
– Issue: How would these Barangays have a specialized ballot that
differs from other Barangays in their municipality?
