claims, injuries, medical
history, and treatment
protocols.

• A form of documentary
evidence
• It is the usual requirement
that the prosecutors office
requires for filling cases of
physical injuries, homicide
and the like.
• medical findings by the
doctor of the injuries you
sustained as a result, say, of
an accident or a crime.
Who is medico legal officer?
• Medical Jurist / Medico-
legal Expert / Medical
Examiner is a physician
who specializes in the
science of legal medicine.
• He must possess sufficient
knowledge pathology,
surgery, toxicology, and
other branches of medicine
in the application to law
and justice.
Where do you get a medico
legal certificate?
 Any hospital may issue a
medico legal certificate.
 However, police authorities
recommend securing one
from a public hospital.
 The reason for this is that in
court proceedings, lawyers
would normally go to great
lengths to impugn the validity
of a medico legal certificate
issued by a public/private
hospital or clinic.
How to secure a medical
certificate for medico-legal
cases?
 Seek treatment
immediately.
 Have medical treatment.
 Request for medical
certificate for medico-legal
cases.
 Proceed to the Records
Section.
 Pay the certificate fee.
PRESIDENTIAL DECREE
No. 169 April 4, 1973
1. The attending physician of any
hospital, medical clinic, sanitarium or
other medical establishments, or any
medical practitioner, who has treated
any person for serious or less serious
physical injuries as those injuries are
defined in Articles 262, 263, 264 and 265
of the Revised Penal Code shall report
the fact of such treatment personally or
by fastest means of communication to the
nearest Philippine Constabulary unit
without delay: Provided, That no fee
shall be charged for the transmission of
such report through government
communication facilities;

2. The report called for in this
Decree shall indicate when
practicable, the name, age; address
and nearest of kin of the patient;
the nature and probable cause of
the injury; the approximate time
and date when, and the place
where, the injury was sustained; the
time, date, and nature of treatment;
and the physical diagnosis and/or
disposition of the patient;

 Medico-legal autopsies

medico-legal autopsies may
include the death-scene
investigation as well as the
ancillary examinations.
What are the contents of the medico
legal report?
• patient’s name and date of birth
• requesting party’s name, date of the
request and purpose of the report
• your credentials, including
professional address, qualifications,
experience and position at the time
you were involved in the patient’s
management
• It should contain:
(NOI) Nature of Incident
(TOI) Time of Incident
(POI) Place of Incident
(DOI) Date of Incident

How long do medico legal
reports take?
 A medico-legal report can
take up to 8 hours to write
and approximately 2x one
hour face to face
consultations to write.

 However, serious cases may


take days or weeks to claim
the result of medico-legal
report.
Notes to Remember when making
Medico-legal Certificate/Report:
• The medico legal certificate/report
should be in a chronological order
with numbered pages.
• The medico legal certificate/report is
to have a detailed summary of the
evidence, based on factual description
and accurate information.
• The expert should refer to important
parts for clarity in the medico legal
certificate/report .
• All the information written in the
certificate/report must be clear,
avoiding any sort of ambiguity.
• It is also significant to mention the
source of information to prove its
authenticity.
