Legal Basis
Article VII, Section 10 (2) of the 1935 Constitution reads:
“The President shall be commander-in-chief of all armed forces of
the Philippines, and, whenever it becomes necessary, may call out
such armed forces to prevent or suppress lawless violence,
invasion, insurrection, or rebellion. In case of invasion,
insurrection, or rebellion, or imminent danger thereof, when the
public safety requires it, he may suspend the privilege of the writ
of habeas corpus, or place the Philippines or any part thereof under
Martial Law.”
Legal Basis
Section 18, Article VII of the 1987 Philippine Constitution
 says that “the President, as commander-in-chief, may “in case of
invasion or rebellion, when the public safety requires it” suspend
the privilege of the writ of habeas corpus or place the country
under martial law”.

The martial law period or suspension of the writ of habeas


corpus should, however, not exceed 60 days. The writ safeguards
individual freedom against arbitrary state action.
