punishment. Amnesty opposes the death penalty in all
cases without
exception - regardless of who is accused, the nature or
circumstances
of the crime, guilt or innocence or
method of execution

• In 1946, murder, rape, and treason were grounds for the
death penalty.
Until 1961, 51 were sentenced to death by the law.
This number soared high under the leadership of
strongman Ferdinand

• Under the Marcos regime, drug trafficking was added to


the list of crimes punishable by death.
• Electric chairs were the primary instrument for execution
during Marcos’ time was used until 1976

• 1976 were replaced by firing squads as the sole method


of execution.
• Under Marcos' 20-year authoritarian rule,
however, countless more people were summarily executed,
tortured or simply
disappeared for opposition to his rule.

• After Marcos was deposed in 1986, the newly drafted 1987


Constitution ( Freedom Constitution) prohibited the death
penalty but allowed
the Congress to reinstate it "hereafter" for "heinous crimes";
making the
Philippines the first Asian country to abolish capital
punishment.
Corazon Aquino on Death Penalty
• certified as urgent a bill proposing death as punishment
for rebellion after the
bloody coup in 1989. A new death penalty law, Republic
Art 7659, was
imposed by President Fidel V. Ramos on Dec. 31, 1993

• While campaigning for the presidency, Fidel Ramos
declared his support for
reinstating the death penalty.
• In 1996 Ramos signed a bill that returned capital
punishment with
the electric chair (method used from 1923 to 1976,
making Philippines the
only country to do so outside U.S.)
• until the gas chamber could be installed". However, no
one was electrocuted
or gassed, because the previously used chair was
destroyed earlier.

• Philippines adopted the method of lethal injection. Some


people were put to
death by this means, until the death penalty was abolished
again in 2006.

• AN ACT PROHIBITING THE IMPOSITION OF DEATH
PENALTY IN THE PHILIPPINES
• Be it enacted by the Senate and House of Representatives of Philippines in Congress
assembled: SECTION 1. The
imposition of the penalty of death is hereby prohibited. Accordingly, Republic Act No.
Eight Thousand One Hundred
Seventy-Seven (R.A. No. 8177), otherwise known as the Act Designating Death by
Lethal Injection is hereby
repealed, Republic Act No. Seven Thousand Six Hundred Fifty-Nine (R.A. No. 7659),
otherwise known as the Death
Penalty Law, and all other laws, executive orders and decrees, insofar as they impose the
death penalty are hereby
repealed or amended accordingly.

• SEC. 2. In lieu of the death penalty, the following shall be imposed: (a) the penalty of
reclusion perpetua, when
the law violated makes use of the nomenclature of the penalties of the Revised Penal
Code; or (b) the penalty of life
• SEC. 4. The Board of Pardons and Parole shall cause the publication at least once a week for three
consecutive weeks in
a newspaper of general circulation of the names of persons convicted of offenses punished with
reclusion perpetua or life
imprisonment by reason of this Act who are being considered or recommended for commutation or
pardon: Provided, however;
That nothing herein shall limit the power of the President to grant executive clemency under Section
19,
Article VII of the Constitution.

• SEC. 5. This Act shall take effect immediately after its publication in two national newspapers of
general circulation.
