Introduction to Collective Bargaining
Collective bargaining is normally means a method
of fixing the terms and conditions of employment
by means of bargaining between the
representatives of an organized body of
employees/ workers and an association of
employers or a body of management.
‘Collective bargaining agent’, in relation to an
establishment or group of establishments,
means the trade union of workers or federation
of trade group of establishments in the matter of
collective bargaining; 2(42), Bangladesh Labor
Code 2006.

• ‘industrial dispute’ means any dispute or
difference between employers and
employers or between employers and
workers or between workers and workers
which is connected with the employment
or non-employment or the terms of
employment or the conditions of work of
any person;

Sec. 209. Raising of industrial disputes : No industrial dispute shall
be deemed to exist, unless it has been raised in accordance with
this chapter by a collective bargaining agent or an employer.
Sec. 210. Settlement of industrial disputes :
Raising disputed issue in writing; (1) If, at any time an employer or
a collective bargaining agent finds that an industrial dispute is likely
to arise between the employer and workers or any of the workers,
the employer, or, as the case may be, the collective bargaining
agent shall communicate his or its views in writing to the other
party.
Arranging dialogue within 15 days; (2) Within fifteen (15) days of
the receipt of a communication under sub-section (1), the party
receiving it shall, in consultation with the representatives of the other
party, arrange a meeting for collective bargaining on the issue
raised in the communication with a view to reaching an agreement
thereon, and such meeting may be held with the representatives of
the parties authorized in this behalf
