Consent

• Section 13 of Indian Contract Act


defines consent as “when two
parties entered into the contract
they should agree upon the
same thing in the same manner”
there should be a meeting of minds
between the two parties.
• Consensus ad idem- meeting of
minds
Free Consent
• According to Section 14, When both the
parties agree to a thing in the same sense
of mind or unison of mind, then the
agreement is considered to be done with
consent. When an agreement is done with
consent and is free from coercion, fraud,
misrepresentation, undue influence, and
mistake.

Free consent refers to an agreement when both parties knowingly and
willingly enter into a contract of their own will.

• COERCION SEC.15 : forcefully, threating a person
Threat to commit suicide—does it amount to coercion???
• UNDUE INFLUENCE SEC 16 : dominating
• FRAUD SEC 17 : Misrepresentation, making false statement
• MISREPRESENTATION SEC.18 : representation that is false, inaccurate,
incorrect etc.
• MISTAKE SEC. 20, 21 AND 22

Elements of free Consent
• Consent is considered to be free consent when the following factors
are satisfied
• It should be free from coercion
• The contract should not be done under the pressure of undue
influence
• The contract should be done without fraud
• The contract should not be made through misrepresentation
