AMENDMENTS TO MLC CONVENTION
Amendment in 2014 (In force Jan 2017)
Regulation 2.5 Repatriation
1)Flag states to ensure that a Financial security
system to support abandoned seafarers by the
ship owner and the fund could be used for -
adequate food, accommodation, drinking water supplies,
essential fuel for survival on board the ship and necessary
medical care ,
Also for outstanding wages and all expenses for
repatriation.
2) The financial security system shall provide
direct access, sufficient coverage and expedited
financial assistance, in accordance with this
Standard, to any abandoned seafarer on a ship
flying the flag of the Member.
3) Require to carry a documentary evidence to
prove the financial security and to be posted at
conspicuous places
Regulation 4.2 Ship owner's liability
1)National laws and regulations shall provide
that the system of financial security to assure
compensation for death or long-term disability
of seafarers due to an occupational injury, illness.
2)the contractual compensation, where set out in
the seafarer’s employment agreement and
without shall be paid in full and without delay.
3)Require to carry a documentary evidence to
prove the financial security and to be posted at
conspicuous places
4)Interim payment in if it is difficult to assess the full
compensation due to the nature of the long term
disability
5) National laws and regulations shall ensure that the
competent authority of the flag State is notified by the
provider of the financial security if a ship owner's
financial security is cancelled or terminated.

Regulation 4.3 (Health and safety protection and
accident prevention)

Amendment to guidelines
Account should also be taken of the latest version of the
Guidance on eliminating shipboard harassment and
bullying jointly published by the International Chamber
of Shipping and the International Transport Workers’
Federation.
Regulation 5.1 Flag State responsibilities
1)Paragraph 4 merged with 3 and added new para4 –
‘Notwithstanding paragraph 1 of this Standard, where, after a
renewal inspection completed prior to the expiry of a maritime
labour certificate, the ship is found to continue to meet
national laws and regulations or other measures implementing
the requirements of this Convention, but a new certificate
cannot immediately be issued to and made available on board
that ship, the competent authority, or the recognized
organization duly authorized for this purpose, may extend the
validity of the certificate for a further period not exceeding five
months from the expiry date of the existing certificate, and
endorse the certificate accordingly. The new certificate shall be
valid for a period not exceeding five years starting from the
date provided for in paragraph 3 in this standard’
2) Appendix A5–II Maritime Labour Certificate also
amended incorporating provision for above extension.

Regulation 2.1 – Seafarers’ employment agreements
Insert a new paragraph 7:
7. Each Member shall require that a seafarer’s
employment agreement shall continue to have effect
while a seafarer is held captive on or off the ship as a
result of acts of piracy or armed robbery against ships,
regardless of whether the date fixed for its expiry has
passed or either party has given notice to suspend or
terminate it
Regulation 2.2 – Wages
Insert a new paragraph 7:
7. Where a seafarer is held captive on or off the ship as a result of
acts of piracy or armed robbery against ships, wages and other
entitlements under the seafarers’ employment agreement,
relevant collective bargaining agreement or applicable national
laws, including the remittance of any allotments as provided in
paragraph 4 of this Standard, shall continue to be paid during
the entire period of captivity and until the seafarer is released
and duly repatriated in accordance with Standard A2.5.1 or,
where the seafarer dies while in captivity, until the date of death
as determined in accordance with applicable national laws or
regulations. The terms piracy and armed robbery against ships
shall have the same meaning as in Standard A2.1, paragraph 7
Regulation 2.5 (Repatriation ) Guidelines
Replace paragraph 8.
The entitlement to repatriation may lapse if the
seafarers concerned do not claim it within a reasonable
period of time to be defined by national laws or
regulations or collective agreements, except where they
are held captive on or off the ship as a result of acts of
piracy or armed robbery against ships. The terms piracy
and armed robbery against ships shall have the same
meaning as in Standard A2.1, paragraph 7.
