COVERAGE OF MEMORANDUM FROM THE
SECRETARY CANCELLING, AMONG OTHERS,
EXSITNG CBFM AGREEMENTS

In order to sustain the efforts and plans of the Department, concerned sectors and donor
agencies for the improvement of Community-Based Forest Management (CBFM) in the
country, all DENR projects supporting CBFM with international commitment are hereby
exempted from the coverage of Memorandum from the Secretary instructing the regions
to cancel, among others, existing CBFM agreements, except those that were previously
cancelled in November 2005 due to low performance.

SUBJECT : CANCELLATION OF ALL EXISTING IFMA, ITPLA,


SIFMA AND CBFMA SUBJECT TO CERTAIN
EXCEPTIONS

DATE : January 05, 2006

1. Based on the review/assessment of this Office, there exists an acute condition of


non-compliance/violation by holders of existing forest tenurial instruments,
specifically Integrated Forest Management Agreement (IFMA), Industrial Tree
Plantation Lease Agreement (ITPLA), Socialized Industrial Forest Management
Agreement (SIFMA) and Community-Based Forest Management Agreement
(CBFMA), relative to the terms and conditions of such instruments, and relevant
rules and regulations, to wit: failure to submit Comprehensive Development and
Management )Plan (CDMP), failure to comply with the terms and conditions of
the approved CDMP, and failure to pay rentals or other required fees, among
others.
2. To ensure the judicious disposition, utilization, management, renewal and
conservation of 5he country’s forest and safeguard public interest, you are hereby
directed to issue appropriate orders immediately canceling all IFMA, ITPLA,
SIFMA and CBFMA in your jurisdiction, except those whose suspension of
timber harvesting operations have been lifted and/or have been made subject of
validation and passed it. Any motion for reconsideration and/or appeal of the
cancellation order shall be forwarded to the Office of the Secretary for appropriate
action.
3. Submit report as to the implementation of this memorandum within fifteen (15)
days from receipt hereof.

SUBJECT :  SUSPENDING THE PROCESSING OF APPLICATION OF IFMA,


SIFMA AND CBFMA

DATE : 12 August 2005

Consistent with the ongoing review of forest tenure instruments nationwide, the processing of
applications for Integrated Forest Management Agreement (IFMA), Socialized Integrated Forest
Management Agreement (SIFMA), and Community Based Forest Management Agreement
(CBFMA) is hereby suspended.

In view hereof, you are hereby instructed to require your respective CENROs and PENROs to
stop accepting applications for IFMA, SIFMA, and CBFMA and refrain from endorsing the same
to the Office of the Secretary.
