P Defination

P spending is divided into three categories based on
the benefits and harm that can occur:
a. Akad which can be implemented in
isolation without the need for guardians if they
only benefit and no risk to him as to
receive grants and charity.
b. Akad which can not
be implemented even with the consent of the
guardian if it only leads
to harm as well spend divorce.
P c. Akad the necessary consent of the
guardian if there is a risk or benefit and harm as
many as trade agreements, deposits, and others.
And had broken the mumayyiz the ratio
between the rights of Allah and the rights of
slaves, namely:
P 1. The rights
of Allah, the legitimate child mumayyiz such
as faith and unbelief, prayer,
fasting and pilgrimage.

1he Natural Causes of lmpediments
P SIGHAR (MINORITY)
P Sighar (minority) is the state or condition of a human
being after birth and before puberty.
P The sabiyy (minor) is liable for compensation of property
destroyed by him, for goods and services bought, for
maintenance of relatives and also for zakat.
P The minor is not liable for the ibadat, for financial
transactions and for punishments.
&N&N (Insanity)
P The insane person is liable for destruction
of property and payment of diyah.
P The insane person has no liability for ibadat
orpunishments and all his transactions are
void.
ATAH (IDIOCY)
P A natural defect for the capacity of
execution (ahliyat al-'ada).
P t is a state in which a person at times
speaks like a sane and normal person,
while at others he is like a madman.
P The capacity of an idiot is deemed
equivalent to that of a sabiyy mumayyiz
(the discriminating minor), who can be
permitted by his guardian tounder take
some transactions.
Nisyan (ForegtfuIness)
orgetfulness does not affect
ahliyah al-wujub nor does it
affect the capacity for execution.
Maradh aI-maut (Death-iIIness)
P Terminal illness., for example, a soldier in the
battlefield or person on a ship threatened by a
storm.
P This is a condition in which the mind of a sick
person is dominated by the fact that he will die
because of his illness.
P Maradh al-maut has no effect on the capacity
for acquisition and the capacity for execution.
S&R (INTOXICATION)
P Drunkenness is a state caused in a human being due to
the use of an intoxicant,
P which temporarily suspends the proper functioning of the
mental faculty.
P ntoxication does not cause a change in the capacity for
acquisition.
P However, the capacity for execution is negated in the
case of the drunken person by the state of drunkenness.
Ikrah (Coercion and duress)
P krah is a situation in which one is forced to
do something without his willingness.
P krah has no effect either on the capacity
for acquisition or the capacity for execution.
Safah ( folly)
P s the opposite of the word rusd ( able to
make discretion ) which signifies the
handling of financial matters.
P A person who under this circumstances is
not allowed to do any transaction unless his
guardian help him.
P A safah is also allowed to possess the
porperty after he reach the level of rush.
