 FACTS OF THE CASE

• Mr. “X” serving as Superintendent (BS-16)

• Owns 4 villas/houses in posh sectors of F-6 and E-7 of
Islamabad
• Possesses 3 plots in different housing societies in his spouse
names
• Purchased agriculture land at Rawalpindi in the name of his two
sons

inquiry, in the light of facts of the case.
• Applicable Rules
• Rule 3 of Civil Servant E&D Rules, 2020 defines
“grounds for proceedings and penalty”
• Rule 3(c) I & ii of Civil Servant E&D Rules,2020 says,
“Considered or reported to be corrupt”

i. he or any of his dependents or any other person through him or on his behalf
in possession (for which he cannot reasonably account) of pecuniary
resources or of property disproportionate to his known sources of income; or
ii. he has assumed a style of living beyond his ostensible means;

FINDINGS

In the light of available facts, The Authority is of the considered opinion that an inquiry
under E&D Rules, 2020 should be initiated against Mr. “X” on account of charges levelled
against him.

Question – II:- Being “Authority” if decided to hold an inquiry issue an
inquiry order in writing.

The competent authority has decided to proceed against Mr. “X” under Civil Servant E&D
Rules 2020 and the following three actions are required to be taken;

• Issuance of Order of Inquiry Rule 2 (1)(c), Rule 9(1)(a) & (c), Rule 10 &

ORDER OF INQUIRY

In pursuance of Rule 2(1)(c) read with Rule 9(1) of the Civil Servants (Efficiency & Discipline) Rules, 2020,
the undersigned in capacity as ‘Authority’ (as notified by Secretary) is pleased to appoint Mr. Ali, JS-Admin,
Ministry of National Food Security & Research, Islamabad as Inquiry Officer to conduct inquiry proceedings against
Mr. “X” Superintendent (BS-16) Ministry of National Food Security & Research, Islamabad. Under Rule 9(1)(c) of the
Rules ibid, Office Dr. Muhammad Ashfaq, Section Officer (Coordination) Ministry of National Food Security &
Research, Islamabad) , is appointed as Departmental Representative to perform functions mentioned in Rule 15 of
Civil Servants (Efficiency and Discipline) Rules, 2020.

2. The inquiry shall be conducted in accordance with the provisions contained in Rule 10 read with Rule 12 of the
Civil Servants (Efficiency and Discipline) Rules, 2020 and shall be completed within 60 days from the date of
issuance or within such extended period which the “Authority” may allow. The Inquiry Officer shall submit the inquiry
report to the Authority within 7 (seven) days of the completion of the inquiry with clear findings as to whether the
charge or charges have been proved or not proved and with specific recommendations regarding exoneration or
imposition of minor or major penalty or penalties upon the accused official.
3. Copies of the charge sheet served upon the accused officer and the statement of allegations are enclosed.

CHARGE SHEET

WHEREAS, I, Khushnood, Àdditional Secretary, Ministry of National Food Security & Research, Government
of Pakistan, as Authority in your case in terms of Rules 3 of the Civil Servants (Efficiency and Discipline) Rules,
2020, read with Rule 6 of Civil Servants (Appointment, Promotion and Transfer) Rules, 1973, am of the opinion that
sufficient grounds exist to proceed against you in terms of Rule 3 (b) & (c) of Civil Servants (Efficiency and
Discipline) Rules, 2020 and have accordingly decided to proceed against you under Civil Servants (Efficiency and
Discipline) Rules, 2020; and
2. WHEREAS, the Authority holds that in light of the facts of the case and in the interest of justice, it is necessary
to hold an inquiry through an Inquiry Officer, in terms of Rule 9 of Civil Servants (Efficiency and Discipline) Rules,

3. WHEREAS, on the basis of the charges / allegations contained in the enclosed Statement of Allegations, you,
Mr. X, Superintendent (BS-16), Ministry of National Food Security & Research, Islamabad, are charged of committing
acts considered or reported to be corrupt as defined in Rule 3(c)(i) and (ii) of the Rules ibid;

4. AND WHEREAS, by reasons of the above and the details given in the enclosed Statement of Allegations, you
are liable to be proceeded against under the Rules ibid, which may involve imposition of one or more of the penalties
including the major penalty of “dismissal from service” prescribed under Rule 4 of the Rules ibid.

5. NOW THEREFORE, you are hereby required to submit your written defence to the charges contained in the
enclosed Statement of Allegations within ten (10) days of the receipt of this Charge Sheet, explaining as to why
disciplinary action as aforesaid, should not be taken against you, and stating at the same time, whether you also desire
to be heard in person.

6. Please take notice that your written defence should reach within the aforesaid period directly to Mr. Ali, JS-
Admin, Ministry of National Food Security & Research, Islamabad who has been appointed as Inquiry Officer, failing
which it shall be presumed that either you have no defence to offer or you have declined to offer the same and
accepted the charges levelled against you and in that case, action shall be taken ex-parte.
