House Bill No. 5808, authored by
Representative Susan Yap-Sulit of
the second district of Tarlac and
36 other co-authors, and Senate
Bill No. 2796, proposed by
Senator Edgardo Angara.

 It was signed into law by Former President Benigno


Simeon C. Aquino III on Sept. 12, 2012.
CYBERCRIME PREVENTION ACT of 2012
or R.A. 10175
 Address cyber offenses such as hacking, data
interference, device misuse, cybersquatting and as
well as other computer-related offenses namely
computer fraud, cybersex and child pornography.
PENALTY of 6 years up to
12 years of imprisonment.

OF 2000
or R.A. 8792
 It was signed into law by
Former President Joseph E.
Estrada on June 14, 2000.
ELECTRONIC COMMERCE ACT
OF 2000 or R.A. 8792
 Deals with "any kind of electronic document used
in the context of commercial and non-commercial
activities to include domestic and international
dealings, transactions, arrangements, arguments,
contracts and exchanges and storage of
information".
MIN. FINE of P100,000 and
mandatory imprisonment of 6 months to 3
years. Other violations of this act will be
penalized with a MAX. PENALTY of
P1 M or 6 years of imprisonment.

5718
 A Bicol lawmaker and a former
Budget Secretary, Rep. Rolando
G. Andaya, Jr. (1st District,
Camarines Sur) is the author of
HB 5718 entitled "An Act
defining and penalizing the crime
of cyber-bullying" or the "Anti
Cyber-Bullying Act of 2015."
ANTI-CYBERBULLYING ACT OF 2015 or
HOUSE OF BILL 5718
 Cyber bullying is defined as "acts of cruelty
committed using the Internet or any form of
electronic media or technology that has the effect
of stripping one's dignity or causing reasonable
fear or physical or emotional harm".
SPECIFIC ACTS OF BULLYING

a. Repeatedly sending offensive, rude, and insulting


message.
b. Distributing derogatory information about the
victim.
SPECIFIC ACTS OF BULLYING

c. Posting or sending offensive photos of the victim,


whether these are digitally altered or not, were
taken with or without consent, with the intention to
humiliate and embarrass the victim.

d. Breaking into an email, social networking or any


electronic account and using the victim's virtual
identity to send, upload or distribute embarrassing
materials to or about others.

e. Sharing the victim's personal information or any


embarrassing information, or tricking the victim
into revealing personal or embarrassing information
and sharing it to others.
SPECIFIC ACTS OF BULLYING

f. Repeatedly sending messages that include threats


of harm or engaging in online activities that cause
fear on the victim's safety.
PENALTY of P50,000 but not more
than one P100,000 and imprisonment
of not less than 6 months but not more than 6
years, or both shall be imposed upon any
person found guilty of cyber-bullying.
“Victims of illegal online activities or targets of
suspicious online messages are encouraged to report
the incidents to the PNP ACG for proper evaluation
and investigation,” the (Philippine National Police
Anti-Cybercrime Group ) PNP ACG said.
