DEFENCE WORKS PROCEDURE (DWP) 2020

The objective is to ensure that all defence works and services – capital,
revenue and maintenance – are completed within time frame and in a
cost-effective manner compatible with the efficient functioning of the
Defence Services..”
BASIC PRINCIPLE OF UNDERTAKING DWP

(1) No new works should be sanctioned without careful attention to the


assets or facilities already available.
(2) Adequate provisions should be ensured for works and services
already in progress before new works and services are undertaken.
(3) If an approved work is not commenced within one year of the date of
AA, RAA from the CFA.
(4) Work shall deemed to be commenced once expenditure is incurred on
preliminary works related to the project.
(5) The completion period stipulated in the AA will not be exceeded as far
as possible.
(6) No works services will be executed without AA, formal allocation of
funds and TS having first been obtained from the Competent Authority
in each case except for wks of Paras 34 to 36 below.
(7) The final cost of any service will not exceed the amount of AA by more
than 10%. For projects costing ₹ 100 crore or above, the Works Review
Committee shall have the powers to accept variation/ tolerance within
10% of the approved estimates.
(8) No project or work services will be split up to bring it within the powers
of a CFA at a lower level.

DEMAND FOR PLANNING OF NEW WORKS
PARA 22

Demands for new Major Capital works services will be submitted in the form of a
Statement of Case to the Competent Financial Authority for consideration and
approval. The SoC will inter alia explain :-
(a) The need for and scope of the works proposed.

Proposals for AMWP works will be forwarded to Comd HQ with a SoC


prepared by the user unit along with Accommodation Statement Part I & II
and RIC worked out by engineers. The shortlisted final proposals of wks
will be forwarded by Service HQs to MoD for apvl by 31st Aug of previous
FY and simultaneously order Comd HQ to issue convening orders for the
prep of bd proceedings/ DPR.
PARA 22

CONTENTS OF SoC

 Scope of proposed wks services with justification, reqmt and


availability of ext services incl tgt dt of completion,
 Deposit wks for other agencies
 Adv amt to be paid to other agencies for prep of estimates viz
Railways, SEBs etc.
 Reqmt of prep wks viz tree cutting, topographic svy, soil
investigation etc.
 Consultancy services for DPR/ for prep of Arch and Structural dwgs,
estimates and tender.
 Separate SoC for Spl Items of wk with full justification.
 Site plan showing loc of proposed site.
 Cert of availability of A1 Def land.
PARA 22(B) & 22(C)

(i) No Wk proposal should be initiated till A1 Def Land is avlb.


Administrative Approval/ Go-Ahead sanction shall be accorded only after
all statutory clearances have been obtained.

(ii) Tenders will be issued only after obtaining cert of encumbrance free
def land/ site from the Stn Cdr. In case of Spl Projs/ wks executed by CCEs
where provn of issue of tender before receipt of Administrative Approval
exists, tenders will be recd only after obtaining cert of encumbrance free
def land/ site from the Stn Cdr.

Apvl of AMWP BPs is reqd to be communicated to engr authorities at the


earliest not exceeding 30 days, after settling any observations thereof to enable
Competent Engineer Authority to finalise the Approximate Estimates.
PARA 28

In case of new wks proposals requiring AA of a CFA of the level of Service Headquarters/ Govt, such
proposals may be submitted to the CFA along with both Board Proceedings and AEs for obtaining AoN
and AA at the same time.

PARA 29(C)

Contingencies will be provided at 3% of the estimates. Establishment ch will not be incl for
MOD establishment wks but will be incl for deposit wks. Establishment ch, if any, may be
incl in the estimates after recording reasons there for in each case, but will not exceed 2%
of the estimates. In addition, consultancy ch not exceeding 3% may be incl in the
estimates. Any addl expdr on consultancy will require the apvl of concerned CFA.

Contingencies will be provided at 3% of the estimates. In addn the fwg charges may also be incl in
the estimates(AE) as per reqmts: -
(i) Establishment Ch. Establishment ch, if any, may be included in the estimates not exceeding 2%
of the estimates for deposit wks.
(ii) Consultancy Ch. The amt of consultancy ch not exceeding 3% of the estimates may be incl
in the estimates which is catered out of bulk Go-ahead sanction with proper justification in the
Engr Appreciation. However for wks where bulk Go-ahead has not been provided, Consultancy
charges not exceeding 3% of the estimates with proper justification in the engr appreciation, may be
incl in the estimates separately. Where consultancy services of specific nature are envisaged
for large projs, provn as reqd (with due justification) may be incl separately.
(iii) Supervisory Ch. When services for supervision of wk are to be hired/ outsourced, an addl
2% of the estimates will be added as a supervisory ch. The reqmt should however be fully
justified in the Engr Appreciation which forms part of the BPs.
(iv) An amt of 3% may be added towards consultancy for dwgs and design wherever Design
and Build/ EPC methodology/ Turnkey projs are adopted. No other ch towards consultancy will
be added in such cases.
PARA 29(G)

In case of wks sch to be completed within two yrs, no escalation, except statutory increases, will be
allowed in the contracts for exec of such works. AEs for such works will be prepared accordingly.

(i) In case of wks with Job Planned Date of Completion (Job PDC) less than two years, no
escalation will be catered for in the AEs. Further, the contract shall also not incl any escalation
clause except statutory increases.

(ii) In case of wks with Job PDC of more than two years, escalation will be allowed only in
contract but not in AEs.

REVISED ADMINISTRATIVE APPROVAL(RAA)

(a) When an AA involves conclusion of a number of contracts and in the event of


the tender cost for the item or items of work exceeding their corresponding AA
amount by more than the permissible tolerance limit and also if there be no
prospect of savings on other items of the work .At the stage of according AA, it will be
ensured that AEs are updated to conform to prevailing percentage of market variation
and difference in cost of stores.
(b) RAA will be essential before tender action if there is any change in scope of
work due to any reason, irrespective of whether the cost is within the tolerance limit
or not.
(c) No change in site is permissible. However, in exceptional circumstances,
change in site can be permitted with approval of CFA one level higher for works
where CFA is Service HQs and below.
(d) If upward revision of cost estimates beyond the tolerance limit is
anticipated without any change in scope of work, then the preparation and
submission of Revised AEs will be initiated. However, tendering and contract
planning may continue; but acceptance of tender/ conclusion of contract will be made
only after obtaining RAA/ FC of the CFA.
(e) No RAA will be essential if increase in cost beyond the tolerance limit is
solely due to payment of statutory escalations scheduled as part of the contract
agreement for the originally stipulated time of completion of the works.
URGENT WORKS (Para 34 to 36)
URGENT WORKS

Para 34 to Para 36
(a) Para 34 : if for urgent military reasons delay involved in the issue of AA based on AEs
cannot be accepted, the CFA is empowered to order commencement of work on essential items
of required work such as collection of store, site clearance, external service, prelim wks etc.
prior to the issue of AA.
(b) Para 35 : Circumstances may arise from unforeseen operational necessity or urgent medical
grounds or out of natural disasters.
(d) Para 36: Again in the case of imminent danger to buildings, roads etc, or of a breakdown of
supply from an E&M or water supply installation, when delay would be seriously detrimental to the
public service
(e) Para 37:The procedures outlined in Paras 34 to 36 above do not dispense with the necessity for the
issue of AA by the CFA. Such works can be started without waiting for specific allotment of funds for the
project.
 
Scope of work shall be finalized by BOO and BPs shall be kept ready before receipt of
tenders for main tender. Issue of covering AA shall be prioritized and issued within 6
months from the date of submission. If delayed beyond six months the AA will be issued
by the next higher CFA.
 
PARA 39

 SPECIAL POWERS FOR ENGINEERS


a) Detailing officers anywhere in the country.
(b) Hiring of office and domestic accommodation for
construction staff.
(c)* Selective tendering.
(d) Procurement of Cement and Steel from open market, if
necessary.
(e)**Dispensing with advertisement for tendering and
contracting.
(f) Engaging specialised construction methods/ technology/
equipment.
Note. 
The expenditure to be incurred for items cited in Sub-Paras (a) & (b) above will be
met out of contingencies of the project.
 
*Dispensation mentioned in Para 38 (c) would be clearly spelt out in the go-ahead
sanction/ AA accorded by the CFA. The reasons for dispensing with
competition will be placed on record in writing.
 
PARA 39

APPOINTMENT OF CONSULTANTS
(a) Engr authorities would be authorised to engage consultancy services for plg of wks relating
to formulation of civ wks projs, prep of feasibility and proj reports incl svy and site investigation
wks as well as for plg, prep of structural/ architectural dwgs and designs, development of
specifications, prep of bill of quantities, cost estimates and constr managements of the proj.

(b) In case of Govt/ semi Govt agencies, the consultancy services may be entered into through
Limited/ selective tendering. Limited tendering amongst private consultants may also be
adopted in cases where the cost of consultancy services is upto Rs. 25 lakhs.

(c) For sanctioned wks, expdr incurred on the consultancy services will be debited to
“consultancy ch” as catered for in AA based on due justification, or to cgy items, where
“consultancy ch” are not incl in the AA.

(d) The expdr towards consultancy services will not gen exceed 3% of cost of the proj.

(f) CE/ CWE is auth to invite Engrs/ Architects/ Management professionals and other specialists
to review imp projs designs and schemes for spl projs/ specialist wks. The expdr shall be made
out of the consultancy ch or proj contingencies
PARA 55(C)

PMG
In case of all projs/wks costing more than Rs. one cr, a representative of the User will be nominated
as Project Officer to coordinate functional aspects of the User’s reqmt with the engrs from the
commencement to the completion of such wks.

PMG
(i) In case of all projects/ works costing more than Rs. 1.50 cr, a representative of the User will be
nominated as Project Officer to coordinate plg and functional aspects of the User’s reqmt with the
engrs from the commencement to the completion of such wks.

(ii) Project Management Group (PMG) to be detailed for projs exceeding Rs. 5 cr by the Stn
Cdr and wks above Rs. 10 cr by the Comd HQ.

(iii) During the exec of the wks, as far as possible, any demand for change in scope of wk or
retrofitting of designs and/ or specifications will be discouraged as it leads to interference
with wks pgmes and delay in completion of the projs.

(iv) Guidelines to be formulated and issued by respective Service HQ with the approval of
MoD regarding the Role, Responsibility and Accountability of PMG in monitoring/ review of
projs. There shall be no cross-interference in functions and responsibilities of Engineer
Authorities and Administrative Authorities.
