• Where the Contract provides for acceleration, the payment for acceleration should be based on the terms
of the contract.

• When the Contract does not provide for acceleration but the Contractor and the Employer agree that
acceleration measures should be taken, the payment basis must be agreed upon before the acceleration
starts.

• When the Contractor takes acceleration procedures on his own to avoid the risk of paying delay penalties
when no approval for EOT request has been issued, in which case the Contractor should not start the
acceleration procedures before taking all the procedures and steps mentioned in the contract to demand an
EOT and in this case this type of acceleration is called Constructive Acceleration.
