“Just Let Us Be” Discrimination Against LGBT Students in the Philippines

Legal basis
The Bill of Rights in the 1987 Constitution guarantees equal protection for every
Filipino, and prohibits discrimination of persons based on ethnicity, race, religion or
belief, political inclination, social class, sex, gender, sexual orientation, gender
identity, gender expression, civil status, medical condition, or any other status in
the enjoyment of rights. The fundamental law also declares that the State values
the dignity of every human person and guarantees full respect for human rights
(Section 11, Article II, 1987 Constitution). It also imposes on the State the duty to
ensure the fundamental equality before the law of women and men.
Summary
So basically it is under the basic characteristics of human rights which is inherent
and universal. Why inherent? Since the day we are born we must obtain the right
to live and the right to choose who wanna be or want to be in the future so no one
has the right to judge and discriminate our own actions and choices in life. Next is
universal it is for all human beings regardless of who they are, what they are,
where they live and it is for all gender regardless if they are gay, lesbian or
whatsoever. Human rights can be used without any borders. The main goal of the
Human Rights is to give peace, freedom and justice to our world.
Article 15- Freedom from torture or cruel in human or degrading treatment or
punishment.
1.) No one shall be subjected to torture or to cruel, inhuman or degrading
treatment or punishment. In particular, no one shall be subjected without his or
her free consent to medical or scientific experimentation.
Facts About Torture

Legal Basis
Name: Anti - Torture Act, 2009 ( R.A 9745 ).
Provides for the right to freedom from cruel, inhumane, and degrading punishment
or treatment, in particular with respect to persons in custody and prisoners.
Issues of Torture
The use of torture physically destroys people. Torture methods, such as sham
execution, rape, sexual assault, humiliation and sleep deprivation often leave
physical consequences on affected persons such as chronic pain in certain parts of
body and inability to lead a healthy and prolonged lifestyle.

Sexual harassment cases in the workplace

Specific issue
• MANILA, Philippines — Twenty-two percent of women and 18 percent of men in
the Philippines have experienced violence and harassment at work, according to a
study by the Lloyd's Register Foundation and pollster Gallup.
• Most of those who reported the incidents said they told a friend, relative or co-
worker. Very few reported the incident to police or community leaders or to
social services.
• The top reason among women respondents for not reporting the incident was
fear for their reputation (73%) while more men hesitated to report the incidents
they felt it would be a waste of time (57%).
Anti-Sexual Harassment Act of 1995 (RA 7877),
Legal Basis
Is the governing law for work, education or training-related sexual harassment. 
It prohibits sexual harassment in the workplace. It defines and describes prohibited
sexual behavior in the workplace, and contains information on how to report a
complaint.
Summary
• In conclusion Sexual harassment is under in universal of human rights Because in
universal of human rights regardless of their race, gender, religion or nationality
everyone deserved to be treated with dignity and respect. We have the right to
be treated fairly because we are equal human being.
Republic Act 9208 or the Anti-Trafficking in Persons Act of 2003, as amended by
RA 10364 also known as the Expanded Anti-Trafficking in Persons Act of 2012
• Trafficking in persons is an illegal act and is considered a violation of human rights. It has
three (3) inter-related and interdependent elements for a situation to be considered
trafficking in persons:
• ACTS – It involves the recruitment, obtaining, hiring, providing, offering, transportation,
transfer, maintaining, harboring, or receipt of persons with or without the victim’s consent
or knowledge, within or across national borders; MEANS – It is committed by use of threat,
or use of force, or other forms or coercion, abduction, fraud, deception, abuse of power or
of position, taking advantage of the vulnerability of the person, or the giving or receiving of
payments or benefits to achieve the consent of a person having control over another
person; and
• PURPOSE – It is done for the purpose of exploitation or the prostitution of others or other
forms of sexual exploitation, forced labor or services, slavery, involuntary servitude or the
removal or sale of organs. The recruitment, transportation, transfer, harboring, adoption or
receipt of a child for the purpose of exploitation or when the adoption is induced by any
form of consideration for exploitative purposes shall also be considered as “trafficking in
persons” even if it does not involve any of the means mentioned above.

Cyberbullying
• Cyberbullying is bullying that takes place over digital devices like cell phones,
computers, and tablets. Cyberbullying can occur through SMS, Text, and apps, or
online in social media, forums, or gaming where people can view, participate in,
or share content. Cyberbullying includes sending, posting, or sharing negative,
harmful, false, or mean content about someone else. It can include sharing
personal or private information about someone else causing embarrassment or
humiliation. Some cyberbullying crosses the line into unlawful or criminal
behavior.
